An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending <br /> Section 104-4.4 of the City Code Relating to"Art in Public Places"to Require Payment <br /> of a Ten Percent(10%)Nonrefundable Deposit for the Cost of the Art Work; Providing <br /> for Severability; Providing for Repealer; Providing for Inclusion in the Code; Providing for <br /> an Effective Date. <br /> (First Reading 12/18/14; Deferred 01/15/15) <br /> Action:City Clerk Hines read the title,and City Attorney Ottinot reported that Section 104- <br /> 4.4 of the City Code requires Applicants to either construct a work of art, or pay into the <br /> Public Art Trust Fund, on the basis of certain cost allocations. This Amendment requires a <br /> 10% nonrefundable deposit if the Applicant is required to make a monetary contribution. <br /> Public Speakers: None <br /> Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the <br /> Ordinance on second reading. RESOLUTIONS <br /> 10A. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Accepting <br /> the Results of the Special Election Which Was Held on Tuesday, February 17, 2015, <br /> Declaring Dana Goldman to be Elected as Commissioner, Seat 3; Ratifying the <br /> Removal of Emanuel Pine, and the Appointment of Gloria Taft to the Canvassing <br /> Board; Discharging the Canvassing Board for the Special Election; Providing for an <br /> Effective Date. <br /> Action: [City Clerk's Note: Documents for this item were distributed prior to the meeting.] <br /> City Clerk Hines read the title, and Mayor Scholl stated that we had a Special Election this <br /> past Tuesday, February 17, 2015. When he had decided to run for Mayor, he was halfway <br /> through his term as Commissioner in the south end of the City. In Florida we have a Resign- <br /> to-Run Rule, he cannot hold two (2)public offices at the same time, or if he should lose,to <br /> keep his old public office and so he had to resign his seat. In doing so,as'our Charter reads, <br /> we make a temporary appointment which was Commissioner Goldman, and within 90 days <br /> we hold a Special Election to fill that seat. There were three (3) candidates in the Election, <br /> and Commissioner Goldman won with 52% of the vote which precluded a run-off. If she <br /> would have gotten less than 50%, we would have had a run-off election. Tonight we can <br /> confirm her,and accept the results of the Election,and discharge the Canvassing Board. City <br /> Clerk Hines administered the Oath and installed Commissioner Dana Goldman. <br /> 17 <br />
