Summary Minutes:Regular City Commission Meeting April 16,2015 City of Sunny Isles Beach,Florida <br /> characterization because historically we have done this before. We have a lot of history <br /> about transferring west-side TDRs to east-side TDRs. Even if we did that, it is still a much <br /> better proposition than going through eminent domain. Gene Newman asked what the City is <br /> paying for that Sales Office,and Mayor Scholl said nothing,and between the two properties, <br /> the compensation for the Alamo property is cash and TDRs, and with the Sales Office, they <br /> are donating the property to the City in exchange for the density that property would have <br /> yielded, about 2,000 feet more. It will be used for the Armani project. All of those <br /> transactions kind of abstracting the TDRs Ordinance but it was designed to transfer density <br /> from a donor's site, when we wanted that site for a public purpose,to make a higher building <br /> within theconstraints that Claudia explained earlier. The reason we packaged it all together <br /> was because they are a motivated seller because they needed the TDRs for the Armani <br /> building. Mayor Edelcup could never get them to the table to finish that deal when he tried <br /> to do it because they were not a motivated seller at that point. In this case it is not really a <br /> sale but they are a motivated donor. We are going through the process right now with the <br /> submerged land. <br /> Commissioner Levin said she knows that Dezer has the option to lease 30,000 square feet, <br /> are they leasing it or are they buying it? Mayor Scholl said they will be buying it as a <br /> condominium, and so they have to commit to that before we approve'the final site plan. <br /> Commissioner Levin said then that we can actually keep it and use it, and Mayor Scholl said <br /> that is correct or if they don't want it, we can make the building smaller and not take on <br /> space that we don't have a buyer for. Ultimately, if they use it, they pan' for it, and if they <br /> don't want it, we don't have to pay for it. Commissioner Levin said then that right now there <br /> is no intention for anybody else to go in there. Mayor Scholl said actually we could but we <br /> are not a building design, until we design the building we will see. Commissioner Goldman <br /> commended the Mayor, City Manager and the City Attorney, staff and everybody that put <br /> this deal together. She said a good deal is a deal that works for both parties, it really worked <br /> well for the developer, it works well for the City, it is multi-purpose.it is public-purpose,it is <br /> an excellent creative solution to attractable problems that we have had with eminent domain, <br /> and she thinks it is excellent and really workable. Vice Mayor Gatto said it is very skilled <br /> negotiations but timing is everything as well. It is very complicated but it worked out <br /> perfectly in so many areas. City Attorney Ottinot noted for the record submerged land offer <br /> was based on statements he gave the Commission previously,and Mayor Scholl said yes,he <br /> just wanted to give an example of how eminent domain can actually get. Commissioner <br /> Levin asked what the changes were to the revised Agreement, was it anything substantive? <br /> City Attorney Ottinot said no,just minor name change and executed signature. <br /> Vice Mayor Gatto moved and Commissioner Levin seconded a motion to approve the <br /> resolution. Resolution No. 2015-2405 was adopted by a voice vote of 5-0 in favor. <br /> 100.
