City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br /> (305) 947-0606 phone (305) 949-3113 Fax <br /> default is beyond the control of both the Architect and such subconsultant, and without the <br /> fault or negligence of either, the Architect shall not be liable for any excess costs for failure <br /> to perform and shall be entitled to an equitable adjustment of Architect's fee. <br /> ARTICLE 6 <br /> THE OWNER'S RESPONSIBILITIES <br /> 6.1 The Owner shall provide full information as to his requirements for the Project. <br /> 6.2 The Owner shall designate a representative authorized to act on his behalf. He shall <br /> examine documents submitted by the Architect and render decisions pertaining thereto <br /> promptly to avoid unreasonable delay in the progress of the Architect's work. He shall <br /> observe the procedure of issuing orders to Contractor only through the Architect. <br /> 6.3 The Owner shall retain a Contractor to construct the Project. The Contractor's services, <br /> duties and responsibilities will be described in the Agreement Between Owner and <br /> Contractor. The Terms and Conditions of the Owner/Contractor Agreement will be <br /> furnished to the Architect. <br /> 6.4 The Owner shall provide a certified survey of the site giving, as required, grades and lines <br /> of streets, alleys. pavements and adjoining property; rights of way, restrictions, easements, <br /> encroachments, zoning, deed restrictions; boundaries and contours of the building site; <br /> locations, dimensions and complete data pertaining to existing buildings, other <br /> improvements and trees; full information as to available service and utility lines, both <br /> public and private; and test borings and pits necessary for determining subsoil conditions. <br /> 6.5 The Owner shall arrange and pay for such legal, auditing and insurance counseling service <br /> as may be required by the Owner for the Project. <br /> 6.6 If the Owner observes or otherwise becomes aware of any defect in the Project, he shall <br /> give prompt written notice thereof to the Architect and Contractor. <br /> 6.7 If the estimate of Construction Cost or Detailed Cost Estimates are in excess of any limit <br /> stated herein, the Owner may give written approval of an increase in the limit or the Owner <br /> shall cooperate in revising the Project scope or quality, or both, to reduce the cost as <br /> required. <br /> ARTICLE 7 <br /> cTt <br /> C1415- PERKINS g WILL ARCHITECTS INC. 13 t� I <br />
