City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br /> (305) 947-0606 phone (305) 949-3113 Fax <br /> The Architect agrees, to the fullest extent permitted by law, to indemnify and hold harmless <br /> the Owner, its representatives, officers,directors, officials and employees from and against <br /> claims, damages, losses and expenses (including but not limited to reasonable attorney's <br /> fees and costs) to the extent the same are caused by the Architect's negligent acts, errors, <br /> mistakes or omissions relating to professional services in the performance of this <br /> Agreement. <br /> The Architect and Owner waive consequential damages for claims, disputes or other <br /> matters in question arising out of or relating to this Agreement. This mutual waiver is <br /> applicable, without limitation, to all consequential damages due to either party's <br /> termination of this Agreement, except as specifically provided in Article 11. <br /> 16.8 Insurance Requirements: <br /> The Architect shall maintain during the terms, except as noted, of this Agreement the <br /> following insurance: <br /> A. Professional Liability Insurance in the amount of One Million Dollars <br /> (51,000,000.00 per claim and aggregate), which shall be the limit of liability <br /> providing for all sums which the Architect shall become legally obligated to pay as <br /> damages for claims to the extent caused by negligent acts, errors, or omissions <br /> pertaining to professional services performed by the Architect. This insurance shall <br /> be maintained for three years after completion of the construction and acceptance <br /> of any Work covered by this Agreement. <br /> B. Commercial general liability insurance with broad form endorsement, including <br /> completed operations and products liability, contractual liability, severability of <br /> interests with cross liability provision, and personal injury and property damage <br /> liability per the CG 00 01 or equivalent with limits of One Million Dollars <br /> (51,000,000.00) combined single limit per occurrence, Two Million Dollars <br /> (52,000,000.00) general aggregate, and Two Million Dollars (52,000,000.00) <br /> products/completed operations aggregate. Said policy or policies shall name <br /> Owner as additional insured. <br /> C. Workman's Compensation Insurance for the employees of Architect as required by <br /> Florida Statutes, Section 440, and employers' liability insurance with limits not less <br /> than One Million Dollars (51,000,000.00) each accident/disease-policy <br /> limit/disease-per employee. <br /> D. Other (or increased amounts of) insurance which Owner shall from time to time <br /> deem advisable or reasonably appropriate, at the Owner's expense when <br /> C° r <br /> 0415- PERKINS& WILL ARCHITECTS INC. 77 L <br />
