In other words, the Original Plans included a residential line
of units located 5 feet from the Property's northwest boundary. Notwithstanding the Code only
requires a five (5) foot rear setback, the Applicant voluntarily increased the Project tower setback to
a minimum of 29'-7" at the narrowest point and 87'-3" at the widest point between the King David
tower and the Project tower. The average setback between the King David tower and the Project
tower is 58'-5" feet.
II. Applicant understands and respects the wishes of the City Commission and is
withdrawing its request for additional density and intensity. The Project contains
less than the maximum permitted density and intensity available to the Applicant
under the Code.
• The Project's biggest physical change is the elimination of the northwest line of
residential units. By eliminating this line, the Project is reduced by approximately
26,362 square feet. Additionally, removing this line of units exposes the King David
to a larger view corridor and increased building spacing between the Project tower
and the King David tower. The Applicant also eliminated an entire residential floor
reducing the Project's floor area by an additional +/- 10,000 square feet.
• Increased building spacing between the King David tower and Project tower. The
Project tower and King David tower are separated by a minimum of 29'-7" and a
maximum of 87'-3"; the average tower spacing is 58'-5". Although not objected to
by the King David Condominium Association, several residents of the Kind David
spoke at the May City Commission hearing with concerns over the Original Project.
After hearing their concerns regarding vehicle circulation and building spacing, the
Applicant reduced the density to 61 units (King David contains 88 units on a site
2
GREENBERG TRAURIG,P.A. • ATTORNEYS AT LAW • WWW.GTLAW.COM •
