Ms.Claudia Hasbun,Zoning Administrator <br /> City of Sunny Isles Beach <br /> Applicant will satisfy the bonus criteria by providing the enclosed parking garage and <br /> paying the applicable fees for the public parking and streetscape bonuses. It is important to reiterate <br /> that the Project satisfies all Code requirements, including, but not limited to setback, height, <br /> building spacing and lot coverage. Moreover, due to the unique and creative design of the building, <br /> Applicant will provide a greater rear setback than allowed by Code and more in tune with the <br /> comments received from certain residents of the King David. Applicant has made an intentional <br /> good faith effort to resolve any and all neighbor concerns. <br /> VI. Traffic: In connection with the Original Project, Applicant submitted a traffic study <br /> prepared by Richard Garcia & Associates, Inc., dated March 30, 2015, including multiple technical <br /> amendments in response to various City comments (collectively, the "Traffic Study"). The Traffic <br /> Study determined the Original Project would result in no net impact to the existing street Levels of <br /> Service ("LOS"). The Traffic Study, and resulting conclusions, were reviewed and verified by the <br /> City's independent traffic engineer. <br /> The revised Project, which decreases the intensity and density of the Original Project, does <br /> not negatively impact the existing LOS. In support of this conclusion, the Traffic Study was <br /> updated with a technical memorandum to reflect the reduced impact of the revised development <br /> program. The updated Traffic Study was verified and confirmed by the City's independent <br /> consultant. Please refer to the response from City' traffic consultant, the Corradino Group, dated. <br /> June 15, 2015, a copy of which is included in the Application file. The Applicant's expert traffic <br /> engineer and the City's expert traffic engineer have conclusively determined that the Proiect will <br /> not negatively impact the existing traffic conditions in the City. To deny this Application on the <br /> grounds that traffic generated by the permitted uses, which are below the maximum levels permitted <br /> under the City's Code, would effectively deny our client the right to develop the Property. Again, it <br /> is important to mention that the existing use includes an 8,533 square foot Denny's restaurant with <br /> existing curb cuts on Collins Avenue and 175th Terrace. The de minimis increase in traffic will not <br /> affect the existing LOS. While traffic can be frustrating, this Project will not create traffic <br /> congestions nor will it exacerbate any existing circulation conditions. <br /> VII. Art in Public Places: Consistent with Section 104 of the Code, Applicant proposes <br /> a beautiful artistic treatment to the building. Please refer to the renderings and elevations in the, <br /> Plans for illustrations of the proposed art sculpture. In sum, Applicant is proposing a structure to <br /> wrap around the garage and the West side of the tower. This art sculpture will shield the garage <br /> from public view, while also creating an interesting and substantial piece of art in favor of the <br /> Project. In addition to the artwork on the garage, the Applicant is continuing the artwork along the <br /> spine of the building facing West, providing aesthetic benefits to the community West of the <br /> Project. <br /> The sculptural wall consists of imaginative wave-shape punched panels inspired by the <br /> waves in the ocean just a few steps from the Property. The design is tied to nature in a cohesive <br /> artistic piece visible from its surroundings. The panels are situated horizontally in a 5' x 30' grid <br /> and constructed of an aluminum composite material. The art sculpture essentially floats on the <br /> building through a concealed aluminum suspension system.
