specific site plan approved by the City Commission. Plans shall include all the required <br />elements of the site plan pursuant to the City's Land Development Regulations and <br />recommendations. Should compliance with recommendations result in a change that <br />would not be considered "minor" in accordance with Section 265-18 of the City Code, the <br />Applicant shall be required to obtain another approval of the City Commission. <br />(4) That in the event of multiple ownership, a homeowner's association shall be established <br />in accordance with applicable regulations to assure that all common areas and facilities <br />for the residents, as well as all easements dedicated to the City, shall be maintained in <br />continuous and satisfactory manner and without expense to the general taxpayers of the <br />City of Sunny Isles Beach. <br />(5) If approved, the Applicant shall submit a separate building permit prior any installation of <br />murals or graphics on temporary construction fencing to be approved administratively by <br />the City Manager or designee. <br />(6) That the Applicant shall comply with all conditions and permit requirements, including but <br />not limited to Miami -Dade County, including environmental conditions and permitting, the <br />Fire and Water and Sewer Departments, Florida Department of Environmental Protection <br />(DEP) and Florida Department of Transportation (FDOT). <br />(7) The Applicant shall coordinate and work with Miami -Dade County Traffic Engineering <br />Department and City of Sunny Isles Beach to develop strategy in order to provide <br />modified and acceptable signal timing plans. The Applicant must take the necessary <br />steps to pursue the signal timing changes consistent with the proposed signal timing <br />plans (i.e. optimized) as documented in the traffic study. <br />(8) That the Applicant shall address comments provided by City's Landscaping Architect <br />regarding landscaping plans submitted during site plan review process. <br />(9) That the Applicant shall address comments provided by City's Traffic Engineer regarding <br />traffic plans submitted during site plan review process. <br />(10)That the Applicant shall address comments provided by City's Civil Engineer regarding <br />Civil plans submitted during site plan review process. <br />(11)That the Applicant shall be responsible for underground all utility lines along 183th Street <br />to the western border of their property. The Applicant further agrees to provide the City <br />with an escrow deposit of $200,000 for the cost of undergrounding the utility lines <br />located adjacent to the gas station on the east side of 183rd Street. If the costs exceed <br />the escrow amount the Applicant shall pay the City the difference.
