such extent as overtime wages are regularly being paid by the CONTRACTOR <br /> for overtime Work of a similar nature in the same locality. <br /> C. All costs of inspection and testing performed during overtime Work by the <br /> CONTRACTOR which is allowed solely for the convenience of the <br /> CONTRACTOR shall be borne by the CONTRACTOR. The OWNER shall have <br /> the authority to deduct the cost of all such inspection and testing from any partial <br /> payments otherwise due to the CONTRACTOR. <br /> D. Unless otherwise specified in the Contract Documents, the CONTRACTOR shall <br /> furnish and assume full responsibility for all materials, equipment, labor, <br /> transportation, construction equipment and machinery, instrumentation, <br /> electronics, tools, appliances, fuel, power, light, heat, telephone, water, sanitary <br /> facilities, and all other facilities and incidentals necessary for the furnishing, <br /> performance, testing, start-up, and completion of the Work. <br /> E. All materials and equipment to be incorporated into the Work shall be of good <br /> quality and new, except as otherwise provided in the Contract Documents. All <br /> Suppliers' warranties and guarantees specifically called for by the Specifications <br /> shall expressly run to the benefit of the OWNER. If required by the ENGINEER <br /> OF RECORD, the CONTRACTOR shall furnish satisfactory evidence (including <br /> reports of required tests) as to the kind and quality of materials and equipment. <br /> All materials and equipment shall be applied, installed, connected, erected, used, <br /> cleaned, and conditioned in accordance with the instructions of the applicable <br /> Supplier except as otherwise provided in the Contract Documents; but no <br /> provisions of any such instructions will be effective to assign to the ENGINEER <br /> OF RECORD, or any of the ENGINEER OF RECORD's consultants, agents, or <br /> employees, any duty or authority to supervise or direct the furnishing or <br /> performance of the Work or any duty or authority to undertake responsibility <br /> contrary to the provisions of Paragraphs 9.9C and 9.9D. <br /> 6.3 ADJUSTING PROGRESS SCHEDULE <br /> A. The CONTRACTOR shall submit any adjustments in the progress schedule to <br /> the ENGINEER OF RECORD for acceptance in accordance with the provisions <br /> for"Submittals" in the General Requirements. <br /> 6.4 SUBSTITUTES OR "OR-EQUAL" ITEMS <br /> A. The CONTRACTOR shall submit proposed substitutes or "or-equal" items in <br /> accordance with the provisions for "Submittals" in the General Requirements. <br /> 6.5 CONCERNING SUBCONTRACTORS, SUPPLIERS, AND OTHERS <br /> A. The CONTRACTOR shall be responsible to the OWNER and the ENGINEER OF <br /> RECORD for the acts and omissions of its subcontractors and their employees to <br /> the same extent as CONTRACTOR is responsible for the acts and omissions of <br /> its own employees. Nothing contained in this Paragraph shall create any <br /> contractual relationship between any subcontractor and the OWNER or the <br /> ENGINEER OF RECORD nor relieve the CONTRACTOR of any liability or <br /> obligation under the prime Contract. <br /> 00700- 12/39 <br />
