such extent as overtime wages are regularly being paid by the CONTRACTOR for overtime Work of a similar nature in the same locality. C. All costs of inspection and testing performed during overtime Work by the CONTRACTOR which is allowed solely for the convenience of the CONTRACTOR shall be borne by the CONTRACTOR. The OWNER shall have the authority to deduct the cost of all such inspection and testing from any partial payments otherwise due to the CONTRACTOR. D. Unless otherwise specified in the Contract Documents, the CONTRACTOR shall furnish and assume full responsibility for all materials, equipment, labor, transportation, construction equipment and machinery, instrumentation, electronics, tools, appliances, fuel, power, light, heat, telephone, water, sanitary facilities, and all other facilities and incidentals necessary for the furnishing, performance, testing, start-up, and completion of the Work. E. All materials and equipment to be incorporated into the Work shall be of good quality and new, except as otherwise provided in the Contract Documents. All Suppliers' warranties and guarantees specifically called for by the Specifications shall expressly run to the benefit of the OWNER. If required by the ENGINEER OF RECORD, the CONTRACTOR shall furnish satisfactory evidence (including reports of required tests) as to the kind and quality of materials and equipment. All materials and equipment shall be applied, installed, connected, erected, used, cleaned, and conditioned in accordance with the instructions of the applicable Supplier except as otherwise provided in the Contract Documents; but no provisions of any such instructions will be effective to assign to the ENGINEER OF RECORD, or any of the ENGINEER OF RECORD's consultants, agents, or employees, any duty or authority to supervise or direct the furnishing or performance of the Work or any duty or authority to undertake responsibility contrary to the provisions of Paragraphs 9.9C and 9.9D. 6.3 ADJUSTING PROGRESS SCHEDULE A. The CONTRACTOR shall submit any adjustments in the progress schedule to the ENGINEER OF RECORD for acceptance in accordance with the provisions for"Submittals" in the General Requirements. 6.4 SUBSTITUTES OR "OR-EQUAL" ITEMS A. The CONTRACTOR shall submit proposed substitutes or "or-equal" items in accordance with the provisions for "Submittals" in the General Requirements. 6.5 CONCERNING SUBCONTRACTORS, SUPPLIERS, AND OTHERS A. The CONTRACTOR shall be responsible to the OWNER and the ENGINEER OF RECORD for the acts and omissions of its subcontractors and their employees to the same extent as CONTRACTOR is responsible for the acts and omissions of its own employees. Nothing contained in this Paragraph shall create any contractual relationship between any subcontractor and the OWNER or the ENGINEER OF RECORD nor relieve the CONTRACTOR of any liability or obligation under the prime Contract. 00700- 12/39
