The purpose of this request is to reduce the <br />square footage of development to be constructed on the property and to comply with new <br />Department of Environmental Protection Regulations pertaining to the setback requirements <br />from the erosion control line. The sole impact to the project is to move the building to the west <br />on the site. All setback regulations of the City have been adhered to. <br />By relocating the garage a distance of 14' 6" to the West and relocating the tower a <br />distance of approximately 20 feet to the West, the site plan will comply with new DEP <br />Regulations. This will also enhance the north/south view corridor on the East, along the beach <br />front. The reduction in square footage reduces the square footage pertaining to the transfer of <br />development rights from 54,385 square feet to 38,847 square feet. <br />Pursuant to Resolution 03 -Z -75, the City Commission of the City of Sunny Isles Beach <br />issued site plan approval for a 42 story, 40 unit condominium on the subject property and <br />preliminary approval for the transfer of development rights pertaining thereto. Although the <br />approved site plan provided for the transfer of 54,385 square feet of development rights, <br />Resolution No. 03 -Z -75 made reference to the transfer of 38,847 feet of development rights. <br />Subsequently, the City Commission adopted Resolution No. 2006 -890 correcting scrivener's <br />error and reforming Resolution No. 03 -Z -75 to reflect that the transfer of development rights <br />preliminary approved by Resolution No. 03 -Z -75 was in the amount of 54,385 square feet.
