<br />ADDENDUM <br />TO <br />BUSINESS LEASE <br /> <br />THIS ADDENDUM ("Addendum") forms a part of the lease ("Lease") dated September <br />I, 1997 between RK Associates, hereinafter called the "Lessor", party of the first pan, and City <br />of Sunny Isles Beach, hereinafter called the "Lessee", party of the second pan. <br /> <br />WIT N E SSE T H: <br /> <br />To the extent the terms of this Addendum conflict with those contained in the Lease, the <br />terms of this Addendum shall controL The terms of the Lease which are not modified by the <br />terms of this Addendum shall remain the same and in effect. <br /> <br />As an inducement for Lessee to accept 17070 Collins Avenue, Suite 250-252, hereunder <br />the "leased premises as a City Hall" for the City of Sunny Isles Beach, which shall include its <br />municipal offices, police headquaners, meeting rooms, public hall, and related municipal <br />functions for the City, Lessor grants Lessee rent concessions as follows: <br /> <br />I. Monthlv Rent! Rent Abatement. <br /> <br />a, It is understood and agreed between the panies the no rent shall be due, <br />and any rent that would otherwise be due shall be abated, until, and not to begin before, the <br />thineenth (13th) month of this Lease. <br /> <br />b. Schedule of Rent Concession: <br /> <br />Lease Period Monthlv Rent <br /> <br />Annual Rate Per Square <br />Foot of Rentable Area <br /> <br />Actual Monthlv Rent <br /> <br />Months <br />1-12 <br /> <br />Base Rent -$17,000 <br />Discount ($12,833,34) <br /> <br />$4.16 <br /> <br />-0- <br /> <br />13 -60 <br /> <br />$4.16 <br /> <br />$4,166.60 <br /> <br />c. During the calendar year 1999, at the sole discretion of the Mayor and the <br />City Council, the base rent in the lease will be reviewed once again. If the city's budget <br />provides for an increase in the rent, Lessor and Lessee will agree on adequate terms for a <br />modification to the terms contained in this Lease Agreement, <br /> <br />d.
