<br />pursuant to Clause 23 of the Base Lease Agreement will be abated and deemed to be included <br />in the above-referenced rent payments, Also, since the city is a municipality, tax exempt status <br />will apply. <br /> <br />2. Delivery of Leased Premises: Lessee is accepting the leased premises in as-is <br />condition, except as otherwise set forth in the Lease, Lessee will undertake all work necessary <br />in order to open the leased premises for business, including receipt of a Certificate of Use and <br />Occupancy, and all zoning approvals and licenses, <br />3. Additional Access, At any time during the lease agreement, in the event the <br />tenants occupying the space in front of the passenger elevators to the leased premises vacate, <br />Lessor. with Lessee's written consent, may construct a handicap accessible elevator, etc. <br /> <br />4. Elevatorl ADA ReQuirement. Lessor agrees, at Lessor's sole cost and expense, <br />to modify the existing shopping center elevators, if necessary, so that it meets all ADA <br />requirements relating to access to elevators and acknowledges that Lessor may construct a <br />handicapped-accessible hallway pursuant to paragraph 3 heretofore. However, that shall in no <br />way affect Lessor's obligation to meet all the ADA requirements relating to access to elevators. <br />After completing the original work necessary for Lessee to occupy the premises at lease <br />commencement, Lessor agrees to make any future changes or improvements to the Leased <br />Premises that may be mandated by applicable laws, ordinances, orders and regulations of <br />federal, state. county or municipal authority now or hereafter in effect. Said changes or <br />improvements shall be made by Lessor only when specifically required of Lessor by such <br />authority or to the extent that Lessor's failure to make the improvements or changes prevent <br />Lessee from operating in the premises. To the extent the existing conditions are "grandfathered <br />in" and changes are not mandated on an immediate basis, Lessor may delay such work. Lessor <br />shall make any ADA-related modifications in the first twelve (12) months of the Lease. <br /> <br />5. Access to Public, Lessor understands and agrees that the City of Sunny Isles <br />Beach shall have meetings of the Commission and/or other boards that are publicly attended and <br />Lessor agrees there shall be access to the public at all times expressly to hold public meetings <br />as well as during normal business hours, <br /> <br />6. ODtion to Renew. The fiftieth (50th) paragraph of the base lease is hereby deleted <br />and substituted with the following paragraph: <br /> <br />Provided that the Lessee is not in default of any terms and <br />conditions of this Lease at the time the option term is scheduled to <br />commence, and commencing September I, 2003, then Lessee shall <br />have the option to be exercised by written notice to Lessor at least <br />three (3) months prior to the expiration of the original term of this <br />Lease to renew this Lease for one (I) additional five (5) year term <br />under all the terms and conditions provided in the original lease <br />and the addenda attached thereto.
