<br />responsible for these improvements. <br /> <br />10. Access to Public. Lessor understands and agrees that the City of Sunny Isles Beach shall <br />have meetings of the Commission (and/or other boards) that are publicly attended and Lessor agrees <br />there shall be access to the public at all times to hold public meetings as well as during normal <br />business hours. <br /> <br />11. Repairs and Maintenance. <br /> <br />A. Lessor shall keep the foundation, the outer walls and roof of the building in which the <br />premises are located and the common areas of the shopping center, electrical system, <br />plumbing system and HV AC systems in good repair, except that Lessor shall not be <br />called upon to make any repairs caused by the negligence of the Lessee, its agents or <br />employees. <br /> <br />B. Lessor warrants the HV AC unit for the leased premises for the duration ofthis Lease. <br />During the term of the Lease, the Lessor shall be responsible for roof repairs and <br />replacement thereof, as necessary, to keep same leak free and in watertight condition. <br />In addition, during the entire term of the Lease, the Lessor, at its expense, shall <br />correct all structural and other defects in the foundation, floor slab, roof and exterior <br />walls of shopping center contained in the leased premises and shall maintain, at its <br />cost and expense, the HV AC system in good operating condition and properly <br />functioning. <br /> <br />C. Lessor agrees to remedy the problem of air contamination inside the leased premises <br />caused by the intake of smoke from the wood-burning stove on the premises leased <br />by the restaurant below in the event of a continuing problem. <br /> <br />12. Police Vehicle Parking:. <br /> <br />A. In conjunction with the Lease Agreement, Lessor hereby grants Lessee the right to <br />utilize portions of the rear parking area, as designated on the attached site plan, for <br />police vehicle parking area. Lessee may install an 8' high chain link fence and electric <br />security gate. The City will petition for a parking variance so that Lessor's parking <br />calculations are not affected by this use of Lessor' s parking lot. Lessee will maintain <br />this area at its sole cost and expense. In the event a variance is not granted, police <br />vehicles will be permitted to park in a mutually agreeable area. <br /> <br />B. Lessor shall assign to Lessee a parking space at 17018 Collins Avenue at the front <br />entrance of the ground floor elevator. This parking space shall be designated with a <br />sign for "Police Vehicle Only." In the event that it is necessary to eliminate the <br />parking spaces for persons transporting young children and strollers in accordance <br />with Section 33-122.2 of the Miami-Dade County Code (also known as "Baby <br /> <br />Page 3 of 7 <br />
