Mr. James DiPietro, City Manager <br />CITY OF SUNNY ISLES BEACH <br />June 25, 1998 (rev 7/17/98) <br />Page Three <br />II. CITY'S RESPONSIBILITIES <br />A. The City Manager shall designate a representative <br />authorized to act in the City's behalf with respect <br />to any Project. The City's Project Coordinator shall <br />examine the documents submitted by the Consultant and <br />shall transmit written decisions pertaining thereto <br />promptly, to avoid unreasonable delay in the progress <br />of the Consultant's services. The City shall observe <br />the procedure of issuing orders to its contractors <br />only through Consultant. <br />B. If the City observes or otherwise becomes aware of <br />any fault or defect in the Project or nonconformance <br />with the contract documents, prompt written notice <br />thereof shall be given by the City to the Consultant. <br />C. The City shall furnish required information and <br />services and render approvals and decisions in <br />writing as expeditiously as necessary for the orderly <br />progress of the Consultant's services and of the <br />Work. No approvals required by City during the <br />various phases of the Project shall be unreasonably <br />delayed or withheld; provided that City shall at all <br />times have the right to approve or reject the <br />proposed submission of Consultant on any reasonable <br />basis. <br />III. FEES <br />A. Fees shall be either billed hourly or on a lump sum <br />basis, depending on the type of project, to be <br />determined when fee is negotiated. Our hourly rates, <br />and those of our engineering consultant, Marlin <br />Engineers, are included herein. <br />B. For projects billed on an hourly basis, a maximum <br />allowable fee will be established, and will not be <br />exceeded unless agreed to by the City. <br />(over) <br />
