The Architect-Engineer agrees that Basic Services <br />Compensation and any authorized additional service compensation shaIl be adjusted to exclude any <br />significant sums by which the Owner determines such compensations were increased due to inaccurate, <br />incomplete or noncurrent wage rates and other factual unit costs. The Owner and the Architect-Engineer <br />agree that all such adjustments in compensation shaIl be made within one year foIlowing completion of the <br />services covered by this Agreement. <br /> <br />16.6 Architect-Engineer's PaymeniRights <br /> <br />Architect-Engineers providing goods and services to the Owner should be aware of the foIlowing time frames. <br />Upon receipt, the Owner has forty (40) calendar days to inspect and approve the goods and services (see <br />Article 9.1(4) hereinabove). The Owner has twenty (20) days to deliver a request for payment (voucher) to <br />the Department of Banking And Finance. The 20 days are measured from the latter of the date the invoice is <br />received or the goods or services are received, inspected and approved. <br /> <br />If the payment is not available to the Owner for transmittal to the Architect-Engineer within 40 days, a <br />separate interest penalty set by the Comptroller pursuant to Section 55.03, Florida Statutes, will be due and <br />payable in addition to the invoice amount. To obtain the applicable interest rate, please contact the Agency's <br />Fiscal Section at (850) 487-9891. The 40 days are also measured from the latter of the date the invoice is <br />received or the goods or services are received, inspected and approved. Interest penalties of less than one (I) <br />dollar will not be enforced unless the Architect-Engineer requests payment. Invoices which have to be <br />returned to an Architect-Engineer because of Architect-Engineer preparation errors will result in a delay in the <br />payment. The invoice payment requirements do not start until a properly completed invoice is provided to the <br />Owner. <br /> <br />A Vendor Ombudsman has been established within the Department of Banking And Finance. The duties of <br />this individual include acting as an advocate for vendors who may be experiencing problems in obtaining <br />timely payment(s) from a state agency. The Vendor Ombudsman may be contacted at (850)410-9354 or by <br />caIling the State ComptroIler's Hotline, 1-800-848-3792. <br /> <br />16.7 Public Entity Crime Information Statement <br /> <br />"A person or affiliate who has been placed on the convicted vendor list following a conviction for a public <br />entity crime may not submit a bid on a contract to provide any goods and services to a public entity, may not <br />submit a bid on a contract with a public entity, for the construction or repair of a public building or public <br />work, may not submit bids on leases of real property to a public entity, may not be awarded or perform work <br />as a contractor, supplier, subcontractor, or consultant under a contract with any public entity, and may not <br />transact business with any public entity in excess of the threshold amount provided in Section 287.017, for <br />CATEGORY TWO for a period of36 months from the date of being placed on the convicted vendor list." <br /> <br />16.8 Unauthorized Aliens <br /> <br />The Department shaIl consider the employment by any contractor of unauthorized aliens a violation of section <br />274A(e) of the Immigration and Nationalization Act. Such violations shaIl be cause for unilateral canceIlation <br />of this contract. <br /> <br />16.9 Contracts Which Require Annual Appropriation; Contingency Statement <br /> <br />No executive branch public officer or employee shall enter into any contract on behalf of the State, which <br />contract binds the State or its executive agencies for the purchase of services or tangible personal property for <br />a period in excess of I fiscal year, unless the foIlowing statement is included in the contract: "The State of <br />Florida's performance and obligation to pay under this contract is contingent upon an annual appropriation by <br />the Legislature. <br /> <br />, ~ <br />_oJ <br />
