<br /> <br />b i::'-\;:,": H ; :',1 Pi., (~T F :~.J:, ::'~ <br /> <br /> <br />This document provides the rationale and data sources used to derive three impact fees for <br />the City of Sunny Isles Beach, Florida. Impact fees are one-time payments that may be <br />imposed by a municipality to offset capital costs to the municipality associated with <br />providing necessary public facilities. Impact fees are subject to legal requirements, which <br />are commonly referred to as the "rational nexus" test. This test contains three elements: <br />need, benefit and Proportionality. First, to justify a fee for public facilities, Sunny Isles Beach <br />has demonstrated that development creates a need for capital improvements. Second, <br />developed properties must derive a benefit from the payment of the fees imposed by the <br />City. Third, the fee paid by a particular type of development should not exceed its <br />proportionate share of the capital cost for improvements. <br /> <br />The City has already adopted impact fees for parks and police facilities (see Figure 1). (TA) evaluated possible methodologies and documented <br />appropriate demand indicators by type of development, for each type of fee. Specific capital <br />costs have been identified using local data and current dollars. Formulas used to calculate <br />impact fees are diagrammed in a flow chart at the beginning of each section of this report. <br />Also, for each type of fee TA provides a summary table indicating the specific factors used to <br />derive the impact fee. These factors are also referred to as Level-Of-Service (LOS) <br />standards. <br /> <br />There are two basic approaches used to calculate the various components of Sunny Isles <br />Beach's impact fees. A plan-based method is best suited for public facilities that have <br />adopted plans or commonly accepted service delivery standards to guide capital <br />improvements. For example, Sunny Isles Beach is planning the construction of a new <br />municipal complex including general government offices, public meeting space and police <br />headquarters.
