<br />Party") snaJJ execute and deliver to the Requesting Party or its mongagee or prospective mongagee
<br />or purchaser, a sworn statement cerlifying: (a) the Commencement Date, (b) (he fact that this Lease
<br />is unmodified and in full force and effect (or, if there have been modifications hereto, that this Lease
<br />is in full force and effect, as modIfied, and stating the date and nature of such modificetions), (c) the
<br />date to which the Rent and other sums payable under this Lease have been paid, (d) the fact that there
<br />are no current defaults under this Lease by either Landlord or Tenant except as specified in the
<br />Responding Party's statement, and (e) such other matters reasonably requested by the Requesting
<br />Party. Landlord and Tenant intend that any statement delivered pursuant to this Paragraph may be
<br />relied upon by any mOr1gagee, beneficiary, or purchaser of the Premises or any interest therein or the
<br />leasehold interest created by this Lease. If, in connection with obtaining financing or refinancing
<br />for the Premises, or any ponion thereof or the leasehold interest created by this Lease, a bank,
<br />insurance or other institutional lender shall request reasonable modifications to this Lease (such
<br />modIfications shall however not include any financial obligations or benefits of either par1y hereto)
<br />or require either party to give notice of any defaults by the other party to such lender and/or permit
<br />such lender to cure the defaults within the reasonable time frames, then in such event, Tenant and
<br />Landlord agree to execute and deliver such modification.

<br />25. Ri2ht to Inspect. Landlord, its employees and agents shall have the right to enter
<br />the Premises at all reasonable times and in emergency situations for the purposes of examining or
<br />inspecting the same, showing the same [0 prospective purchasers, mOrlgagees, or tenants,
<br />performing cleaning and maintenance, and making such alterations, repairs, improvements or
<br />additions to the Premises which may be, in Landlord's discretion, necessary or desirable or to cure
<br />Tenant's default; provided, however, that Landlord provides Tenant with notice, if such notice is
<br />practical. and if such entry is not required in the event of an emergency. U representatives of Tenant
<br />shall not be present to open and perrrjt entry into the Premises at any time when such entry by
<br />Landlord is necess3.l)' or permitted hereunder, Landlord, its employees and agents may enter by
<br />means of a master key (or forcibly in the event of any emergency), without liability of Landlord to
<br />Tenant and without such entl)' constituting any eviction of Tenant or termination of this Lease.
<br />Landlord shall be under no obligation to enter upon the Premises. or portions thereof, and cure any
<br />defaults of the Tenant
<br />
<br />26 Surrender of Premises. Tenant shall, upon the expiration or prior termination of
<br />the term of this Lease, surrender to Landlord the Premises in the condition In which the Premises
<br />were at the Commencement Date, ordinary wear and tear excepted, together with all repairs, changes,
<br />alterations, fixtures, additions, and improvements thereto. Notwithstanding the for~going, provided
<br />Tenant is not in default hereunder. Tenant shall have the option, in its sole discretion, [0 remove any
<br />or all above-ground automotive lifts and/or waste oil containment equipment installed on the
<br />Premises by Tenant and aU above-ground or underground storage tanks and related piping whether
<br />or not installed by Tenant, provided that Tenant shall restore the Premises from any damages
<br />resulting from such removal, said removal is done in compliance with all applicable Regulations and,
<br />with respect to the properly located in Orange County, Florida, Tenant shall obtain Landlord's
<br />written consent prior to any such removal. Tenant shall indemnify Landlord against any loss or
<br />liability resu]tlr1g from delay by Tenant in so surrendering the Premises, including v,'ithou[ limitation
