<br />The IG may, on a random basis, perform audits on all County contracts throughout the duration <br />of said contract (hereinafter "random audits"). This random audit is separate and distinct from <br />any other audit by the County. To pay for the functions of the Office of the Inspector General, <br />any and all payments to be made to the Recipient under the Grant Agreement will be assessed <br />one quarter of one percent of the total amount of the payment, to be deducted from each <br />progress payment as the same becomes due unless, as stated in the Code or the Grant <br />Agreement, the Project is federally or state funded and federal or state law or regulations <br />preclude such a charge. The Recipient shall in stating its agreed prices be mindful of this <br />assessment. <br /> <br />The IG shall have the power to retain and coordinate the services of an independent private <br />sector inspector general (IPSIG) who may be engaged to perform said random audits, as well as <br />audit, investigate, monitor, oversee, inspect, and review the operations, activities and <br />performance and procurement process including, but not limited to, project design, <br />establishment of bid specifications, bid submittals, activities of the contractor, its officers, <br />agents and employees, lobbyists, County staff and elected officials in order to ensure <br />compliance with contract specifications and detect corruption and fraud. <br /> <br />F) If a Recipient materially fails to comply with any term of an award, the Board or the County <br />Manager may take one or more of the following actions, as appropriate in the circumstances: <br /> <br />1) Temporarily withhold cash payments pending correction of the deficiency by the Recipient; <br /> <br />2) Disallow all or part ofthe cost of the activity or action not in compliance; <br /> <br />3) Wholly or partly suspend or terminate the current award for the Recipient's Project; <br /> <br />4) Withhold further Funding Allocation awards from the Recipient; or <br /> <br />5) Take other remedies that may be legally available. <br /> <br />G) Any of the enforcement actions listed in paragraph F above, taken by the County Manager, <br />which are contested and unresolved between the Recipient and the County within thirty days of <br />such action, will result in the Board providing the Recipient with an opportunity to be heard on <br />the issue. Said hearing will occur within sixty days of the Board receiving the Recipient's <br />written request. Staff will recommend appropriate action to the Board. <br /> <br />H) Costs to Recipient resulting from obligations incurred by the Recipient during a suspension or <br />after termination of an award are not eligible for reimbursement unless the County Manager <br />expressly authorizes them in the notice of suspension or termination or subsequently authorizes <br />reimbursement in writing. Other costs incurred by the Recipient during suspension or after <br />termination which are necessary and not reasonably avoidable are eligible for reimbursement if: <br /> <br />1) The costs result from obligations which were properly incurred by the Recipient before the <br />effective date of suspension or termination, were not in anticipation of it, and in the case of a <br />termination, are non-cancelable; and <br /> <br />2) The costs would be eligible for reimbursement if the award was not suspended or if the <br />award expired normally at the end of the funding period in which the termination takes <br /> <br />Building Better Communities Administrative Rules <br /> <br />200f22 <br />
