SunGard shall deliver the computer hardware described in <br />Schedule A Contract #20060200 no later than sixty (60) days from execution of this Agreement. <br />For hardware ordered under any subsequent Supplement Schedule A, SunGard shall deliver the <br />computer hardware as promptly as is reasonably possible in conjunction with SunGard's <br />manufacturer's current production schedule (normally 30-60 days), SunGard shall not be held liable <br />for delay in delivery, installation, or service beyond its reasonable control. <br /> <br />Shipment. Computer hardware shipments to the Customer's installation site shall be made by <br />SunGard in an industry acceptable mode of transportation to provide utmost protection of the <br />equipment; SunGard shall prepay all charges therefore and will invoice same to Customer for <br />reimbursement. Customer agrees to reimburse SunGard for all Customer computer hardware <br />transportation, insurance and special handling charges. <br /> <br />Risk of Loss. Risk of loss for computer hardware will pass to Customer when the computer <br />hardware is received at the Customer's designated location. <br /> <br />Hardware Capacity. It is expressly understood and agreed between SunGard and Customer that <br />Customer has elected to purchase hardware from other sources that is sufficient to meet Customer's <br />needs and is compatible with SunGard's Licensed Program(s). Customer understands that <br />SunGard's Licensed Program(s) is frequently enhanced and therefore SunGard's minimum <br />hardware specifications are subject to change without notice to the Customer. <br /> <br />Other accessories (hardware or software) may be required for the use of the Licensed Program(s). <br />Except as agreed otherwise in writing, SunGard assumes no responsibility under this Agreement <br />for obtaining or supporting such accessories. Customer is also responsible for ensuring a proper <br />environment and proper utilities for the computer system on which the Licensed Program operates, <br />including an uninterrupted power supply. <br /> <br />XIV. ACKNOWLEDGEMENT OF SUNGARD HTE'S DEPENDENCE ON CUSTOMER'S <br />GIS DEPARTMENT <br /> <br />Customer acknowledges and agrees that SunGard's ability to provide the Licensed Program(s) and <br />services relating to Geographic Information System (GIS) or relating to Maps or relating to <br />geographic analysis, etc. is contingent on the Customer providing SunGard with the resources and <br />data for SunGard's Implementation Guide for Map Projects, if applicable. <br /> <br />Customer shall provide SunGard with the following accurate GIS resources and accurate data in an <br />ASCII EOO format file for street centerlines containing: <br /> <br />9 <br /> <br />COS06-45-1 SunGard Software License and Services Agreement <br /> <br />S\B <br />
