Hines, City Clerk <br /> <br />MEMORANDUM <br /> <br />1)1e Honorable City Commission <br />vjohn Szerlag, City Manager ' <br /> <br /> <br />/ <br /> <br />FROM: Hans Ottinot, City Attorney <br /> <br />DATE: November 28, 2006 <br /> <br />RE: Adoption of Special Assessment Resolution <br /> <br />As preliminary preparation for a discussion relating to a proposed special assessment for the <br />Atlantic Isle residential area, this memorandum discusses the steps that the City must follow in <br />order to impose a special assessment for sewer improvements in the Atlantic Isle area, <br /> <br />Step 1- Hirinl!: ora Consultant <br /> <br />The City must retain a consultant to prepare a special assessment report. This report will assist <br />the City Commission in determining: (1) whether the properties assessed derive a special benefit; <br />and (2) whether the apportionment is fair and reasonable, For your convenience, I have attached <br />a special assessment report prepared by Tischler & Associates for Landscaping Improvement <br />Project for Collins Avenue. The report was prepared in 2001. The City Commission did not <br />pursue this project. <br /> <br />Step 2- Adoption of a Resolution <br /> <br />The City is required to adopt a resolution to declare the special assessment. Section 170,03, <br />Florida Statutes, The resolution must contain the following: (1) the nature of the proposed <br />improvements and the location of the sewer improvement; (2) the total estimated cost of the <br />improvement (includes the cost of construction or reconstruction, cost of labor and materials, <br />etc.); (3) the part of the project to be paid by special assessment and the general improvement <br />fund of the City; (4) the manner in which the assessments are to be paid; and (5) the lands upon <br />which the special assessment shall be levied, <br /> <br />ATTACHMENT 3 <br />
