CITY OF SUNNY ISLES BEACH FIRST AMENDMENT TO 181sT DRIVE ACTIVE PARK INSPECTION SERVICES AGREEMENT DATED AUGUST 31, 2004 CONTRACT NO.: C0607-008 THIS AMENDMENT is made and entered into this ~day of D~2006, by and between the CITY OF SUNNY ISLES BEACH, FLORIDA, a municipal corporation of the State of Florida, (hereinafter referred to as "City") and CALVIN, GIORDANO & ASSOCIATES, INC., a Florida corporation located at 1800 Eller Drive, Suite 600, Fort Lauderdale, Florida 33316, (hereinafter rcferred to as "Consultant"). WHEREAS, pursuant to Resolution No. 2005-852, adopted on November 17, 2005, the City Commission approved an Agreement with Consultant ("Master Agreemcnt"), hcreinafter referred to as Attachment "A", for construction management and inspection services for the Activc Park facilities locatcd at 18115 North Bay Road, in an amount not to exceed Onc Hundred and Two Thousand Nine Hundred and Seventy-Eight Dollars and Seventy-Five Cents ($102,978.75); and WHEREAS, the City Administration wishes to expand Consultant's scope of services to include additional construction management services for thc Active Park facilities, such that Consultant will serve as thc "Construction Manager" and assume the duties of coordinating all the necessary permit and plan approvals with the projcct contractor, architect and enginccr to insurc a timely completion of the Active Park facilities; and WHEREAS, thc Consultant has submitted a Work Authorization No. 89, dated November 29, 2006, incorporating its proposal to provide the requcsted construction management serviccs for a total fee of Thirty-Nine Thousand Three Hundred and Twelve Dollars ($39,312.00), as more fully described in Attachmcnt "8" which is attached hcreto and madc a part hereo f; and WHEREAS, if Consultant's Work Authorization No. 89 as refcrcnccd in Attachment "B" is approvcd by the City Commission, the total aggrcgatc contract will bc Onc Hundred Forty-Two Thousand Two Hundred and Ninety Dollars and Seventy-Five Cents ($142,290.75); and WHEREAS, thc City Commission wishes to expand the scope of services and amend the contract price of the Master Agrcement to reflect a new total contract price not to exceed Onc Hundred Forty-Two Thousand Two Hundred and Ninety Dollars and Seventy-Five Cents ($142,290.75). NOW THEREFORE, in considcration of the premiscs and the mutual covenants herein stated, the parties hereto agree as set forth below: 1. AMENDMENT TO SCOPE OF SERVICES.
