<br />The Dcclaration of Condominium which was filed with and approvcd by the State of Florida, <br />Department of Busincss and Professional Regulation, Division of Florida Land Salcs, <br />Condominiums and Mobile IJomes, and recorded in the Public Records of Miami-Dade Coullly, <br />Florida, describes Unit No. 304 as a residential unit, owning a 0.78313% undivided share in the <br />common elements of the Condominium. Enclosed herewith for your reference are rccorded excerpts <br />from the Declaration and the Prospectus ofthc Marina Bay Club Condominium, Hotel. <br /> <br />It is clear hom the foregoing that IVIr. and Mrs. Nobre purchased Unit No. 304 in good faith <br />and with the full knowledge and belief that this Unit was in compliance with all applicable legal <br />requirements. As a result, it came as a complete surprise to them that the Unit might not satisfy the <br />City's zoning restrictions.
