This figure is given only as a <br /> guideline for preparing an offer and should not be construed as representing actual or guaranteed <br /> purchases under any new contract. <br /> 1.4 Eligible Users • <br /> All Florida government and educational entities are considered Eligible Users of the Office and <br /> Educational Consumables State Term Contract. This includes all State agencies, school districts, <br /> universities, community colleges, counties, cities, towns, villages, special districts, and other entities <br /> approved by the Department. With the consent of the successful Respondent(s), purchases may also <br /> be made under the terms and conditions of this solicitation by governmental and educational entities <br /> located outside the State of Florida. Appropriate governmental and educational entities' purchasing <br /> laws, rules, and regulations shall apply to purchases made under this contract. Eligible Users and <br /> governmental entities are defined in Florida Administrative Code and Statutes as described below: <br /> Rule 60A-1.005, Florida Administrative Code, identifies Eligible Users as: <br /> • <br /> • All governmental agencies, as defined in Section 163.3164, F.S., which have a <br /> physical presence within the State of Florida; <br /> • Any independent, nonprofit college or university that is located within the State of <br /> Florida and is accredited by the Southern Association of Colleges and Schools. <br /> Section 163.3164, Florida Statutes: <br /> • (10)"Governmental agency" means: <br /> o The United States or any department, commission, agency, or other <br /> instrumentality thereof. <br /> o This state or any department, commission, agency, or other instrumentality <br /> thereof. <br /> 618-001-10-1 Office and Educational Consumables ITN Page 8 of 77 <br />
