delivered are <br /> accurate <br /> Order $0 $0 $1,000 $1,000 $2,000 $3,000 <br /> Completeness/ <br /> Fill — less than <br /> 95% <br /> Price Accuracy $0 $0 $2,000 $3,000 $4,000 $5,000 <br /> — less than <br /> 99.5% <br /> *Note: If respondent fails to meet the performance standards 5 or more times in a 12 month contract <br /> period, the State shall have grounds to initiate contract breach and termination proceedings. <br /> 5.6 Liability Insurance and Worker's Compensation <br /> During the Contract term, the Contractor at its sole expense shall provide commercial insurance of <br /> such a type and with such terms and limits as may be reasonably associated with the Contract, <br /> which, as a minimum, shall be: workers' compensation and employer's liability insurance per Florida <br /> statutory limits (currently $100,000 per accident, $100,000 per person, and $500,000 policy <br /> aggregate) covering all employees engaged in any Contract work; commercial general liability <br /> coverage on an occurrence basis in the minimum amount of $500,000 (defense cost shall be in <br /> excess of the limit of liability), naming the State as an additional insured as its interest may appear; <br /> and automobile liability insurance covering all vehicles, owned or otherwise, used in the Contract <br /> work, with minimum combined limits of$500,000, including hired and non-owned liability, and $5,000 <br /> medical payment. Providing and maintaining adequate insurance coverage is a material obligation of <br /> the Contractor and is of the essence of the Contract. Upon request, the Contractor shall provide <br /> certificate of insurance. The Contract shall not limit the types of insurance Contractor may desire to <br /> obtain or be required to obtain by law. The limits of coverage under each policy maintained by the <br /> Contractor shall not be interpreted as limiting the Contractor's liability and obligations under the <br /> Contract. All insurance policies shall be through insurers authorized to write policies in Florida. <br /> 5.7 Performance Bond <br /> If deemed necessary, the Customer may require the Contractor to furnish (without additional cost) a <br /> performance bond, a negotiable irrevocable letter of credit or other form of security for the faithful <br /> performance of work. Determination of the appropriateness and amount of any bond requirement, is <br /> the sole responsibility, and at the sole discretion, of the Customer. <br /> 5.8 Ongoing Performance Measures <br /> The Department intends to use performance-reporting tools and service level agreements as outlined <br /> in this solicitation, in order to measure the performance of Contractors. Such measures assist the <br /> Department in ensuring that Contractors provide the best possible value to the State and end users. <br /> The State reserves the right to modify and introduce additional performance-reporting tools as they <br /> are developed, including online tools (e.g. tools within MFMP or on the Department's website). <br /> 5.9 Contract Reporting Requirements <br /> The Contractor shall report sales data to the Contract Manager on a quarterly basis using the <br /> Contract Quarterly Reporting Form in Attachment G—Quarterly Reporting Form of this ITN. <br /> The following summary data must be reported to the Contract Manager on a quarterly basis: <br /> • Total purchases on the contract for the quarter <br /> • Total purchases on the contract for the quarter by Eligible User <br /> • Total purchases for the quarter made using the State's Purchasing Card <br /> • Total Certified Vendor (including Minority, Women, and Service-Disabled Veteran) <br /> purchases for the quarter by Eligible User. <br /> The following detailed data must be reported to the Contract Manager on a quarterly basis in Excel <br /> spreadsheet format: <br /> • Eligible User(Customer) Entity Name <br /> 618-001-10-1 Office and Educational Consumables ITN Page 41 of 77 <br />
