3.02.03 <br /> <br />3.02.04 <br /> <br />3.02.05 <br /> <br />3.02.06 <br /> <br />A V-CHOICE-2009 <br />MP-5320 (10/09) <br /> <br />) <br /> <br />a) The child is the natural child or stepchild of the Subscriber; a legally adopted child in <br />the custody of the Subscriber from the time ofplacemcnt in the home (written evidence <br />of adoption must be l'nmished to AvMed upon request); a child for whom the Subscriber <br />has been appointed legal guardian, pursuant to a valid court order; or a newborn child <br />ofa covered Dcpendent of the Subscriber (such coverage terminates 18 months after the <br />birth of the newborn child); <br /> <br />b) The child resides with the Subscriber (except for 'e' and 'g' below); <br /> <br />c) The child is under the age of 19 (except for 'e' and 'f below, or Section 3.04 below); <br /> <br />d) The child is principally dependent upon the Subscriber for maintenance and support and <br />is not regularly employed by one or more employers for a total of 30 hours or more per <br />week; <br /> <br />) <br /> <br />e) The child, from age 19 through the end of the calendar year when the child turns 25, if <br />the child meets the following requirements: <br /> <br />I) The child is dependent upon the Subscriber for support; and <br /> <br />2) The child is living in the household of the Subscriber or the child is a Full-Time or <br />Part-Time Student. See Section 2.22. <br /> <br />f) The child is age 19 or over and is wholly dependent on the Subscriber due to mental <br />retardation or physical handicap. See Section 3.05. <br /> <br />g) It is the Subscriber's responsibility to notify AvMed when the child no longer meets <br />these requirements. Termination of coverage may be retroactively applied if AvMed is <br />not notified within 31 days. Subscriber agrees to provide supporting documentation <br />upon request by AvMed. <br /> <br />In the event that the enrolled Dependent child, who is a Full-Time or Part-time Student, <br />suffers from a serious illness or injury requiring a leave of absence from school which would <br />otherwise cause the Dependent child to lose eligibility under the plan, coverage will be <br />extended for one year from the first day of the leave of absence or the date on which <br />coverage under the plan would otherwise terminate, whichever occurs first. AvMed will <br />require written certification from a treating physician stating the Dependent is suffering from <br />a serious illness or injury and that the leave of absence is Medically Necessary. <br /> <br />lu the cvent an eligible Dependent child does not reside with the Subscriber, coverage will <br />be extended when the Subscriber is obligated to provide medical care by a Qualified Medical <br />Child Support Order. You (or your beneficiaries) may obtain, without charge, copies of the <br />Plan's procedures governing Qualified Medical Child Support Orders and a sample Qualified <br />Medical Child Support Order by contacting the Plan Administrator. <br /> <br />In the case of a newborn child, AvMed should be notified in writing prior to the scheduled <br />delivery date of the Subscriber's intention to enroll the newborn child, but such notice shall <br />not be later than 31 days after the birth. If timely notice is provided, no additional preminm <br />will be charged for the additional coverage of the newbom during the 31-day period <br />following the birth of the child. If timely notice is not provided, the additional premium for <br />the additional coverage of the newborn child will be charged from the child's date of birth. <br />If notice is not provided within 60 days of the birth, the child may not be el110lled until the <br />next open enrollment period of the Snbscribing Group. <br /> <br />All services applicable for covered Dependent children under this Contract shall be provided <br />to an enrolled newborn child of the Subscriber or to the enrolled newborn child of a covered <br />Dependent of the Subscriber or to the newborn adopted child of the Subscriber provided that <br /> <br />) <br /> <br />) <br /> <br />9 <br />
