<br />Performance Guarantee <br /> <br />Based on the data and information received, we have evaluated the results as noted in the <br />ETI's "Summary Form", and hereby guarantee the "First Year Estimated Utility Savings" in <br />ETI's "Savings Profile", per our proposed package. Provided that the following conditions <br />remain the same as those reported on the ETI's "Measurement Sheet" and "Summary <br />Form": <br /> <br />1. KW, and KWH consumption. <br />2. Hours of Operation. <br />3. Units of Production. <br />4. Degree hours. <br /> <br />As you can clearly see, the projected savings will be affected dependent upon tolerance of <br />all the above conditions. Any variations to the above conditions will be identified by the <br />Statistical Path Analysis (SPA) software, which is based on the regression analysis, and the <br />results will be pro-rated accordingly. If for the period of two years from the date <br />ElectroFlow™ is in continuous operation, and based on the SPA pro-rated results, you have <br />not realized the said savings of "First Year Estimated Utility Savings" as above mentioned, <br />and indicated in the ETI's "Savings Profile", Allbrite will make up the difference, for the first <br />year only - GUARANTEED. <br />If you anticipate any changes in the above factors for the near future, please inform us so <br />that we can evaluate the effect(s) upon the "First Year Estimated Utility Savings". <br /> <br />12 <br />
