BACKGROUND: On July 19, 2012, Staff presented the City Commission with a recommendation of award to Lukes. The recommendation was subsequently withdrawn at the request of the City Attorney in order to investigate further certain concerns raised by one of the proposers. The City Attorney's Office has investigated the matter as it relates to one of Lukes' employees. Based on his investigation, the City has advised staff it can proceed with the original recommendation that it made for landscaping services at the Commission meeting on July 19, 2012. Since the City Commission meeting on July 19th, staff had conducted additional due diligence to determine whether the, proposers are able to perform to the standards that the City may require. Specifically, staff met with the proposers to discuss scope of work issues and mobilization. Based on these interviews and proposal reviews, and after receiving clarification from the City Attorney, I find that Lukes is the most responsible and responsive bidder whose proposal best serves the interests of, and represents the best value to, the City per Section 62-8 of the City Code. The enumerated factors include, but are not limited to, (1) capacity, ability and skill of the provider to perform the contract, (2) whether the provider can perform the contract within the time specified without delay or interference, and (3) the quality of performance of previous contracts by the provider. Lukes Sawgrass Landscaping, Inc. meets or exceeds all factors outlined in Section 62-8 of the City Code. Notably,Lukes was the City's landscaper for several years prior to the City retaining the services of another vendor. /� Agenda Item C Date 1-2 ( - IiZ.
