Base Lines and Bench Marks: <br /> <br />The Engineer will be the only person in charge of establishing Base Lines and Bench Marks <br />(BM's). The Contractor shall layout his work from these engineering control points and shall be <br />responsible for all measurements in connection with the construction, subject to check and <br />correction by the Engineer. The Contractor shall furnish all labor and material, at his expense, <br />necessary to facilitate engineering control of the work. <br /> <br />7. Pavment of Test bv Citv: <br /> <br />Except when otherwise specified in the Special Provisions, the expense of all tests requested by <br />the Engineer will be borne by the City. Procedure for making tests required by the Engineer will <br />be in conformance with the Florida Department of Transportation Specifications for the particular <br />material involved. Tests rendering unsatisfactory reports shall be cause for rejection. The cost for <br />all retesting shall be deducted from the final payment made to the Contractor. <br /> <br />8. Engineer: <br /> <br />The supervision of the execution of this Contract is vested wholly in the Engineer, and the orders <br />of the City Manager are to be given through him. The instructions of the Engineer are to be <br />strictly and promptly followed in every case. The Contractor may designate a foreman or other <br />representative to receive such instructions in his absence, and failing to do so, he will be held <br />responsible for the execution of any instructions it may be necessary to give in his absence. <br /> <br />The Engineer is to have free access to the materials and the work at all times for laying out, <br />measuring, inspecting or directing the same, and the Contractor is to afford him all necessary <br />facilities and assistance for so doing. The Engineer's stakes, grades or lines are to be preserved <br />by the Contractor, or reset at the Contractor's expense. <br /> <br />To prevent all disputes and litigations, it is agreed by the parties hereto that the Engineer shall <br />decide all questions, difficulties and disputes of whatever nature which may arise relative to the <br />interpretation of the Plans, construction, prosecution and fulfillment of this Contract, and as to the <br />character, quality, amount and value of any work done and materials furnished under or by reason <br />of this Contract, and his estimates and decisions upon all claims, questions, and disputes shall be <br />final and conclusive upon the parties thereto. <br /> <br />Inspectors shall have no authority to permit deviations from, or to relax any of the provisions <br />of these General Specifications without the written permission or instruction of the Engineer, or <br />to delay the Contract by failure to inspect the materials and work with reasonable promptness. <br /> <br />The payment of any compensation, whatever may be its character or form, or the giving of any <br />gratuity, or the granting of any valuable favor by the Contractor to any Inspector. directly or <br />indirectly, is strictly prohibited and any such act on the part of the Contractor wi]] constitute a <br />violation of this Contract. <br /> <br />The Engineer will appoint such inspectors as are necessary to pass upon the amount, quality and <br />character of the materials to be supplied or to supervise the execution of the work contemplated <br />under this Contract.
