Subcontractors: <br /> <br />The Contractor is as fully responsible to the City for the acts and omissions of his subcontractors <br />and of persons either directly or indirectly employed by said subcontractor, as he is for the acts <br />and omissions of persons directly employed by him. Nothing contained in the Contract <br />Documents shall create any contractual relations between any subcontractor and the City. <br /> <br />29. Final Cleanin2,-Up <br /> <br />Upon completion of the work specified herein and before acceptance and final payment shall be <br />made, the Contractor shall remove from the site all machinery, equipment, surplus and discarded <br />materials and temporary structures. All disposal of materials, rubbish and debris shall be made at <br />a legal disposal site or by other prior approved manner. Material cleared from the site and <br />deposited on adjacent or nearby property will not be considered as having been disposed of <br />satisfactorily. <br /> <br />30. Non-Discrimination in Emplovment: <br /> <br />In accordance with this Proposal, the Contractor agrees to make no discrimination because of <br />race, color, creed or national origin with respect to employment or personnel on this project. and <br />that all persons having the experience and skill necessary to perform the Work shall be afforded <br />equal opportunity of employment for the Work to be performed at the site of this Project. <br /> <br />31. Conflict ofInterest Ordinance: <br /> <br />The Contractor agrees to abide and be governed by Miami-Dade County Ordinance No. 72-82 <br />(Conflict of Interest Ordinance), as amended, and the provisions of Section 62-l6, Code of the <br />City of Sunny Isles Beach, which is incorporated herein by reference as if fully set forth herein, in <br />connection with its Contract obligations hereunder. <br /> <br />32. Independent Private-Sector Inspector General (IPSIG): <br /> <br />The City shall have the right but not the obligation to retain the servIces of an independent <br />private-sector inspector general (IPSIG) who may be engaged to audit, investigate, monitor, <br />oversee, inspect and review the operations, activities and performance of the Contractor and City <br />in connection with this Contract. The scope of services performed by an IPSIG may include, but <br />are not limited to, monitoring and investigating compliance with Contract Specifications; project <br />costs; and investigating and preventing corruption and fraud. <br /> <br />The IPSIG may perform its services at all levels of the contracting and procurement process <br />including but not limited to project design, establishment of bid specifications, bid submittals, <br />activities of the Contractor, its officers, agents and employees, lobbyists, city staff and elected <br />officials. <br /> <br />Upon (10) ten days written notice to the Contractor from an IPSIG, the Contractor shall make all <br />requested records and documents available to the IPSIG for inspection and copying. The IPSIG <br />shall have the right to examine all documents and records in the Contractor's possession, custody <br />or control which in the IPSIG's sole judgment pertain to performance of the Contract, including <br />but not limited to original estimate files, bid and change order estimates, worksheets, proposals <br />and agreements from and with successful and unsuccessful subcontractors and suppliers, all <br />project-related correspondence, memoranda, mstructions, financial documents, construction <br /> <br />General Specifications Oct. 2007 <br /> <br />Page 140f15 <br />
