<br />completed application, the City Manager or his designated representative shall review <br />said application and, if satisfactory in all respects, and after payment of required <br />application fee of Seven Hundred Fifty ($750.00) Dollars, shall issue the Franchise. <br /> <br />Section 1.04. <br /> <br />Denial of Franchise. <br /> <br />Should the City Manager deny an application for a Franchise, he shall notify the <br />applicant of such denial by certified mail not later than fourteen (14) days after taking <br />such action. The notice of denial shall contain a statement of the reasons why the <br />application was denied. <br /> <br />Section 1.05. ~ppeal from City Manager's denial of Franchise; appeal from <br />revocation of Franchise under Section 1.11. <br /> <br />The denial or revocation of a Franchise by the City Manager may be appealed to the <br />City Commission. The notice of appeal shall be filed in writing with the City Manager <br />no later than fourteen (14) days after the receipt of the certified letter advising <br />applicant of the denial or revocation. The City Manager shall fix the date and time for <br />hearing the appeal. Said hearing shall be held not less then fourteen (14) nor more <br />than sixty (60) days after receipt of the notice of appeal. The City Commission shall <br />either affirm the decision of the City Manager or direct the City Manager to issue or <br />reinstate the Franchise. <br /> <br />Section 1.06. <br /> <br />Tenn of Franchise. <br /> <br />Franchises awarded pursuant to the provisions ofthis Ordinance shall expire one (1) <br />year from the date of issuance. <br /> <br />Section 1.07 <br /> <br />Renewal of Franchise. <br /> <br />A Franchise may be renewed from year to year by the City Manager. Any such <br />renewal may be subject to the same terms and conditions applicable to the issuance <br />of the original Franchise except application fee. <br /> <br />Section 1.08. <br /> <br />Transfer of Franchise prohibited. <br /> <br />No Franchise for the collection of solid waste issued under the provisions of this <br />ordinance may be assigned or transferred, In the event of any change in ownership <br />and/or name of the corporation or partnership, formal notification shall be given the <br />City Manager within thirty (30) days thereof. That upon any sale, a new Franchise <br />license shall be obtained from the City. <br /> <br />Section 1.09. <br /> <br />.
