<br />Section 2. <br /> <br />Section 3. <br /> <br />Section 4. <br /> <br />Section 5. <br /> <br />Grants and Gifts. Each year, if and when the City of Sunny Isles Beach receives <br />monies from any source, be it private or governmental by grant, gift or otherwise to <br />which there is attached a condition of acceptance, any limitation regarding the use or <br />expenditure of the funds so received need not be shown in the operating budget nor <br />shall such budget be subject to amendment of expenditure as a result ofthe receipt of <br />said monies, but said monies shall be disbursed and applied toward the purposes for <br />which said funds were received. To insure the integrity of the operating budget and <br />the integrity of the monies received by the City under grants or gifts, all monies <br />received as contemplated above must, upon receipt, be segregated in accounts based <br />on generally accounting principles and where appropriate, placed in separate and <br />individual trusts and/or escrow accounts from which any money drawn may only be <br />disbursed and applied within the limitations placed upon the gift or the grant as <br />aforesaid. <br /> <br />Post Audit provided. Each year, pursuant to Article 4.10 of the City Charter and <br />Section 218.23(1 )(b) Florida Statute, the City Commission hereby provides for annual <br />post audit of the City's financial account and may thereby be eligible to participate in <br />revenue sharing beyond the minimum entitlement in any fiscal year. The City <br />manager is authorized to take all action necessary to cause such post audit to be made <br />by a certified public accountant or firm of such accounts in accordance with the law. <br /> <br />Severability. The provisions ofthis Ordinance are declared to be severable and if any <br />section, sentence, clause or phrase of this Ordinance shall, for any reason, be held <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining <br />sections, sentences, clauses and phrases of this Ordinance but they shall remain in <br />effect, it being the legislative intent that this Ordinance shall stand notwithstanding <br />the invalidity of any part. <br /> <br />Effective Date.
