<br />02001- 2nd Rdg MU-R District <br />5/30/01 - 9:51 AM <br /> <br />development and including a paved access way which may include pavers <br /> <br />and pedestrian amenities in accordance with adopted municipal design <br /> <br />standards for public beach access walkways. For the purposes of this <br /> <br />section, "public access" means non-exclusive unencumbered and <br /> <br />unrestricted access to the public: except however, that upon request of the <br /> <br />grantor or property owner, the City Commission may accept a restriction <br /> <br />upon the grant or dedication limiting the hours of general public access to <br /> <br />daylight hours, provided that the City shall have unrestricted access for fire <br /> <br />and police protection and provided that the grantor or property owner shall <br /> <br />bear the full expense of installing a gate always accessible to police and fire <br /> <br />protection personnel and equipment. The beach access easement may be <br /> <br />located over parking structures provided that the highest elevation of the <br /> <br />underlying structure supporting the beach access way may not exceed six (6) <br /> <br />feet above grade. The F .AR. may be increased by a maximum of ten one- <br /> <br />hundredths (0.10) for the dedication, improvement and maintenance of the <br /> <br />minimum beach access described above. As provided in Section 33-222 <br /> <br />above, where it is determined by the City Manager, that in the interests of <br /> <br />protecting the public safety and welfare, provision of a beach access way at <br /> <br />a mid-block location constitutes a potential safety hazard as an inducement <br /> <br />to illegal pedestrian crossings of Collins Avenue, in lieu of the dedication <br /> <br />and improvement of a beach access way, the bonus increase in F.AR. of .10 <br /> <br />may be achieved in accordance with the following subsection (ii). <br /> <br />Page 21 of36 <br />
