<br />501.10 Restriction Upon Variance and Other Development Applications. Under <br />those circumstances in which work has been done or a use has been <br />established or conducted without obtaining the necessary building permit or <br />development order, no application for a variance, conditional use, <br />temporary use, new use or site plan approval (the "approval") related to <br />such construction work or to such use may be considered by the City <br />Commission, unless the violation which resulted from the conduct of such <br />construction work or the establishment or conduct of such use, is halted so <br />as to remedy the violation of the City's LDRs. Cessation of activity is <br />required prior to the application being submitted for review. <br /> <br />Under those circumstances in which a permit or development order was <br />issued for the conduct of construction work or the establishment or conduct <br />of a use, but which nevertheless gives rise to the necessity for an approval <br />application because of non-compliance with permit or development order <br />conditions or otherwise, no application shall be accepted for review until <br />the violative activity has ceased. <br /> <br />501.11 Quasi-Judicial Proceedings. The following applications are quasi-judicial <br />and shall comply with the City's quasi-judicial legislation: <br /> <br />a) Site specific rezoning. <br />b) Conditional use applications. <br />c) Variances, <br />d) Development of regional impact. <br />e) Plats. <br />f) Site Plans. <br /> <br />g) Any other development approval deemed to be quasi-judicial by the <br />City Attorney. <br /> <br />501.12 Time Limit. Within two years after the Commission takes affirmative <br />action approving an application for a variance, conditional use, other quasi- <br />judicial zoning approval (other than a rezoning) or site plan approval (the <br />"approval"), the approval must be utilized in accordance with its terms.
