When taking affirmative action to approve an application, the <br />Commission may extend the time limitations set forth above, by <br />specifically authorizing a longer period of time for utilization of the <br />approval. Additionally, the Commission may grant a time extension for <br />utilization of the approval upon a showing of good cause in an application <br />for extension of time filed prior to the expiration of the initial time period. <br />An approval shall be deemed to be utilized if the use pursuant thereto shall <br />have been established, or if a building permit has been issued, acted upon <br />and the development to whic~.. such rlproval is an integral part is <br />progressively and _ly cAR'" nclusion. <br /> <br />501.13 Payment of fees. All participation unit bonus fees shall be due and payable <br />prior to the issuance of the first building permit. <br /> <br />501.14 General Development Provisions <br /> <br />1. Time Periods/Expiration - Completed Application. A completed <br />application (as determined by the Zoning, Planning and Building Director) for a <br />development order submitted after the effective date of these LDRs shall be <br />valid for a period of six (6) months. The application shall expire on the six (6) <br />month anniversary of the submission date of the application in the event a <br />development order based upon said application has not been obtained by said <br />date. The application shall expire earlier in the event of the final denial of the <br />application prior to the expiration of the six (6) month period. <br /> <br />2. Time Periods/Expiration - Development Order. Each and every <br />development order issued by the City pursuant to these LDRs shall be valid for <br />a period of twenty-four (24) months from the date of issuance of the <br />development order and a building permit must be obtained dwing said twenty- <br />four (24) month period (and construction begun and continue thereunder) except <br />in the event a different time period to obtain a building permit is expressly <br />authorized by the City Commission and set forth in the development order. The <br />foregoing sentence shall apply to development orders for all developments, <br />inclusive of multiphase projects. A development order shall expire earlier in the <br />event any condition or requirement of the development order containing a <br />specific time period for performance is not timely satisfied as provided therein. <br />In the event a building permit is not timely obtained or thereafter expires (or due <br />to noncompliance with express conditions) and a development order expires, as <br />provided above, it shall be deemed null and void and a new development order <br />shall be required prior to development consistent with the LDRs then in effect. <br />This section shaD not apply to land use plan amendments or rezoning <br /> <br />3. Extensions of Time. If a developer desires additional time (beyond the <br />twenty-four (24) month or other specified period), the developer may request an <br />extension from the City Commission by completing an application for extension <br />prior to the expiration of the twenty-four (24) month or other specified period. <br />The City Commission shall consider any such request on a case by case basis, <br />and may grant an extension for a period of time deemed reasonable by the City <br /> <br />City of Sunny Isles Beach-Land Development Regulations <br />Adopted December 10,2002 <br /> <br />CHAPTER 5 - Development Review 500-4 <br />
