<br />Commission if the developer clearly establishes good cause for the extension <br />and that the need for the extension is based substantially on events or <br />occurrences beyond the control of the developer; provided, however, while the <br />(i) inability to obtain financing, (ii) volatility in the economyand/or (iii) <br />changes in the market conditions affecting a project, as examples, may not <br />constitute circumstances beyond the control of the developer, two or more of <br />these factors combined and/or in combination with other relevant factor, may be <br />sufficient as determined by the City Commission, to establish the need for the <br />extension. <br /> <br />4. Building Permit Validity and Expiration. Upon issuance of a building <br />permit to effectuate development approved by a development order, the rules <br />and regulations of the Florida Building Code, as amended by [Miami-Dade <br />County or City of Sunny Isles Beach], if applicable, shall determine the period <br />of validity of the permit, subject to the City's completion date requirements as <br />set forth in these LDRs. However, in the event a building permit expires and <br />becomes null and void, the development order for which the permit was issued <br />shall contemporaneously expire and become null and void. This section shall <br />not apply to land use plan amendments or rezoning <br /> <br />5. Completion Date. All development authorized by a development order <br />pursuant to these LDRs shall be complete and shall have satisfied all <br />requirements for issuance of a certificate of occupancy or certificate of <br />completion, as applicable, within twenty-four (24) months from the date of <br />issuance of the building permit authorizing development as approved in the <br />development order, except in the event a different time period to obtain a <br />certificate of occupancy or certificate of completion, as applicable, is expressly <br />authorized by the City Commission and set forth in the development order. If <br />additional time (beyond the twenty-four (24) month or other specified period), <br />is desired by a developer, the developer may request an extension from the City <br />Commission as more particularly set forth in Section 3, above. <br /> <br />Section 502: Permitted Uses. <br /> <br />502.1 Pwpose. Permitted uses are considered to be fundamentally appropriate <br />within the district in which they are located and are deemed to be consistent <br />with the Comprehensive Plan. These uses are permitted as of right, subject <br />to the required permits and procedures descn"bed in this section. Permitted <br />uses require final site plan review and approval for compliance with the <br />standards applicable to a particular permitted use as provided in these <br />LDRs. <br /> <br />502.2 Permits Required.
