<br />Commission, after it is determined that the application is complete. An <br />advertisement shall be placed in a newspaper of general paid <br />circulation in the City and notice of said application shall be mail to all <br />affected parties within a 500 foot radius, in the same manner as for <br />zoning hearing applications. A fee for the consideration of this <br />application shall be set from time-to-time, and shall be approved by <br />the City Commission. <br /> <br />i) Filing, processing and notice procedures for placing the request <br />on the agenda shall be pursuant to conditional use procedures <br />set forth in the LDRs. <br /> <br />ii) The application shall include plans, construction schedules, site <br />conditions map including a perspective and/or mass model of <br />the proposed development, which demonstrates the "as of <br />right" development potential as compared to the development <br />potential utilizing the proposed transfer of development rights, <br />status of financing and a general description of the manner in <br />which the project shall be constructed. The plans shall include, <br />but not be limited to, a site plan elevation, landscaping, an area <br />analysis of surrounding properties including but not limited to <br />street elevations, height of buildings, surrounding floor area <br />ratio and density, impact if any of the transfer of development <br />right to adjacent properties, copies of any covenants affecting <br />the receiver and sending site, and any other agreements <br />required by the Land Development Regulations and this <br />Ordinance. <br /> <br />iii) Every application should include the signature of all owners of <br />all properties involved in the application (sender and receiver <br />sites) . <br /> <br />b. Variances. Transfer of Development Rights shall not be permitted for <br />Receiver sites that have applied for public hearings to obtain density <br />or floor area ratio variances for the site. <br /> <br />c. Evaluation Criteria. A request for transfer of development rights <br />shall only be approved if the City Commission, after it examines the <br />information requested in Paragraph a. ii. Herein above, finds that the <br />application is consistent with the following mandatory criteria: <br /> <br />i) The project is consistent with the Comprehensive Plan and will <br />not reduce the levels of service set forth in the plan. <br /> <br />ii) The project is consistent with the intent of these regulations set <br />forth in this Ordinance. <br /> <br />City of Sunny Isles Beach-Land Development Regulations <br />Adopted December 10,2002 <br /> <br />CHAPTER 5 - Development Review 508-41 <br />
