<br />Department, a copy of the final order as set forth herein. The final order <br />shall be recorded against both the transfer and receiving properties and <br />shall include the amount of development rights that were transferred and <br />received for each property, the amount of required parking that shall <br />always be made available to the receiving site and it shall be in the form <br />of an irrevocable covenant running with the land, to be dissolved only if <br />the floor area that was buih on the receiving property is completely <br />removed. The applicant shall agree to bind itself: its successors, heirs and <br />assigns of the property and the development with regard to the conditions, <br />if any, that are placed on the development. The receiving sites shall then <br />exist, in perpetuity, and any changes in the development sball not occur <br />until approved at a public hearing by the City Commission.. All <br />documents to be recorded shall first be approved by the City Attorney. <br />Any changes in the development may not occur unless the City <br />Commission approves such changes. <br /> <br />515.9 Penalties for Violation. Any person who shall violate a provision of <br />this section, or fail to comply therewith, or any of the requirements <br />thereof: shall, upon conviction in the County Court, be punished by a fine <br />not to exceed $500.00, or by imprisonment in a county jail for not more <br />than sixty (60) days, or both such fine and imprisonment at the discretion <br />of the judge. Any person, who violates or fails to comply with this <br />section, shall also be subject to fines in accordance with the code <br />enforcement provisions of the City's Code. Each day any violation and <br />non-compliance of any provision shall continue, can constitute a separate <br />offense. <br /> <br />515.10 Civil Liability. <br /> <br />a. Any person who violates a provision of this section or any lawful <br />rule, regulation or written order promulgated under this section is <br />subject to injunction or other equitable relief to enforce <br />compliance with or prohIbit the violation of this section. Further, <br />such person is liable for any damages to the City caused by such <br />violation, and for the reasonable costs and expenses incurred by <br />the City in enforcing the provisions of this section, including but <br />not limited to the costs of enforcement inspections, preparation of <br />enforcement reports, photographs, title searches, postage and other <br />demonstrable administrative costs for enforcement and collection. <br />All such sums shall become immediately due and payable upon <br />expenditure by the City and shall become delinquent if not paid <br />within thirty (30) days after receipt by the violator of the City's <br />bill itemizing the enforcement costs incurred in enforcing the <br />provisions of this section.
