<br />e) Boundaries indicated, as approximately following mean high water lines or <br />centerlines of canals, bays, or other bodies of water shall be construed as <br />following such mean high water lines or centerlines. In the case of a change <br />in mean high water line, the boundary shall be construed as moving with the <br />change, except where such moving would change the zoning status of a lot or <br />parcel, in which case the boundary shall be interpreted in such manner to <br />avoid such change. <br /> <br />f) Where uncertainties continue to exist and/or further interpretation is required <br />beyond that presented in the above paragraphs, the question shall be presented <br />to the Planning, Zoning and Building. Any person aggrieved by such decision <br />made by the Planning, Zoning and Building Director may appeal that decision <br />to the City Commission <br /> <br />702. Interpretations of District Regulations <br /> <br />The Sections that follow present a brief statement of interpretation of the district regulations <br />set forth in Section 703, Schedule of District Regulations. <br /> <br />702.1 Statements of Purpose and Intent <br /> <br />The purpose and intent statement presented for each zoning district sets forth the <br />underlying and primary purpose and intent of a given district. <br /> <br />702.2 Permitted Uses <br /> <br />a) It is the intent of this Ordinance to permit any use, not otherwise prohibited by <br />law, to locate in a specified zoning district( s), either as a permitted use, a <br />conditional use or a temporary use. In the event there is not a particular use <br />listed in the Ordinance that corresponds with the use in question as determined <br />by the Planning, Zoning and Building Director then it shall be interpreted that <br />the use in the Ordinance having the most similar characteristics as the use in <br />question shall govern except in the event the use is expressly prohtbited <br /> <br />b) The term 'permitted uses' represents only those uses that are permitted by right <br />in a given district and does not apply to uses otherwise allowed by conditional <br />use approval. <br /> <br />c) No structure shall hereafter be built or moved, and no structure or land shall <br />hereafter be used or occupied, except for a use that is permitted in the zoning <br />district in which the structure or land is located. <br /> <br />d) No use shall be allowed in any district that is not permitted by the regulations <br />for the district. <br /> <br />city of Sunny Isles Beach-Land Development Regulations <br />Adopted December 10, 2002 <br /> <br />ZONING DISTRICTS 700 - 3 <br />
