<br />Summary Minutes: Regular City Commission Meeting March 19,2009 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />violations for trash on the beach; traffic coming northbound have to turn in front of that traffic <br />island in front ofLe Meridian, and there is no signal there which causes dangerous traffic; and <br />there is an impact on parking. Ms. Burke responded that there are ongoing problems with <br />these two buildings, this is a public beach, and as for the chair set-up, any City regulations that <br />are in effect will be respected by Le Meridian. She said when they initially had 1,000 <br />memberships in effect they only had 10-12 people there, and the parking situation has been <br />resolved with the parking agreement. <br /> <br />Mayor Edelcup said one of the other comments was the policing of the beach, and Ms. Burke <br />said she will make sure her client is aware ofthat and they will step up any cleanup activities <br />that are needed. Commissioner Goodman asked who monitors the 240 memberships, and Ms. <br />Burke said they would give quarterly or semi-annual reports of how many memberships have <br />been sold. City Attorney Ottinot noted that there are 19 memberships at this time. Vice <br />Mayor Thaler said the limit of 240 memberships should be in writing, and this area is <br />continually dirty until after the chairs are put out at 8:00 a.m., 50% of the space is being used <br />instead of the 25% for the chairs. Community Development Director Robert Solera said there <br />is only one Code Enforcement Officer assigned to the area of Collins A venue and the beach <br />from north to south, and sporadic checks at least four times a day at different times, and the <br />Corporation is aware of the chair situation, as well as the cleanup. Commissioner Scholl said <br />the issue is that the Applicant has been remiss in adhering to our laws, and that is what these <br />people are upset with. Mr. Solera said warnings have been issued as well as a ticket for $500, <br />and the next time, will be a repeat violation of $750, and we have the potential to do the <br />cleanup ourselves and charge the owner. Vice Mayor Thaler said additional garbage cans <br />were put out there and the situation is better, and to see if additional cans are needed. <br /> <br />Mayor Edelcup said the City Manager needs to determine operations, the Commission <br />shouldn't get involved in the day-to-day cleaning of the beach, only at the policy issues. <br /> <br />Vice Mayor Thaler moved and Commissioner Brezin seconded a motion for approval, <br />subject to staff conditions, and the additional conditions oflimiting memberships to 240, <br />and entering into the Parking Agreement.
