A Proclamation to be Accepted by Ed Hernandez, Director of the South Florida Water <br />Management District's Miami-Dade Service Center, Proclaiming the Month of April 2009 <br />as "Water Conservation Month" in the City of Sunny Isles Beach. <br />Action: Community Development Director Robert Solera reported. Mayor Edelcup read the <br />Proclamation into the record and presented it to Lewis Beilman of the South Florida Water <br />Management District. <br /> <br />5C. Presentation of a Flag/Plaque by Army Sergeant Nick Perdomo to the City of Sunny Isles <br />Beach through the Building Department. <br />(Deferred from 02/19/09) <br />Action: Building Official Clayton L. Parker introduced Sgt. Perdomo who presented the <br />City with a Plaque/Flag that was flown over Afghanistan in appreciation of the service he <br />received from the City's Building Department. <br /> <br />6. ZONING: ZONING HEARINGS ARE QUASI-JUDICIAL PUBLIC HEARINGS. <br /> <br />6A. Request of Fortune International Hospitality, LLC d/b/a Le Meridian Beach Resort, <br />Owner of the Property Located at 18630 Collins Avenue, for the following: (Hearing <br />#Z2008-09) <br /> <br />The Applicant is requesting a Conditional Use to establish a Beach Club. <br /> <br />1. Pursuant to Section 265-13 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a Conditional Use approval for the <br />establishment of a Beach Club. <br /> <br />Protests 0 <br /> <br />Waivers <br /> <br />o <br /> <br />Ex Parte 0 <br /> <br />Action: [City Clerk's Note: An amended cover memo and Development Review Report were <br />distributed prior to the Meeting. See action under Item 4A.] Mayor Edelcup gave opening <br />remarks on zoning procedures/decorum and City Clerk Hines read a disclaimer for the <br />Zoning hearing, and administered the oath to the witnesses for the Zoning hearing. <br />Community Development Director Robert Solera reported, and noted that the Applicant has <br />entered into a Parking Agreement resolving the parking issue. <br /> <br />Public Speakers: Judith A. Burke, Esq.; Joseph Ryan <br /> <br />Judith A. Burke, Esq., representing the Applicant, said because ancillary uses that make up the <br />Beach Club were included within the Site Plan approved by the County, Fortune was unaware <br />that a separate approval was needed. The Beach Club was opened when the Hotel opened, but <br />shut it down when the City advised that a conditional use approval was required. Fortune <br />agreed to limit the use of the Beach Club to only 240 memberships, and executed a parking <br />agreement with the City for up to 60 parking spaces to accommodate any potential overflow, <br />either under the William Lehman Causeway or within the Heritage Park Parking Garage at the <br />City's option. All parking at the Resort and the Beach Club will continue to be valet parking. <br /> <br />Joseph Ryan a resident ofthe Millennium Condominium south ofLe Meridian, was opposed <br />to the Beach Club and said there have been repeated problems including: guests pouring over <br />to their side of the beach; beach chairs are not set up correctly; they have a history of <br /> <br />2 <br />
