An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending <br /> Section 193-9 of the Code of Ordinances of the City of Sunny Isles Beach Entitled "Permits <br /> for Waiver for Construction Noise" to Require an Applicant to Provide a Copy of the <br /> Permit Application and Permit Approval or Denial to the Adjacent Property Owners; <br /> Providing for Severability; Providing for Inclusion in the Code; Providing for Repealer; <br /> Providing for an Effective Date. <br /> (First Reading 07/21/16) <br /> Action: City Clerk Hines read the title, and Deputy City Manager Morris reported this <br /> Ordinance requires the applicant to provide copies of the reasons for requesting the extended <br /> hours to the adjacent property owners as well as a copy of our approval or denial. <br /> Public Speakers: None <br /> Mayor Scholl said we are trying to tighten up our rules to be able to, and it may be a little <br /> more onerous for developers but basically it makes them prove it up that they need it, and <br /> also to deal with adjacent property owners. Quite frankly when we give extended hours, <br /> there is a lot of good technical reasons why we give the extended hours but at the same time <br /> the adjacent property owners are often the ones that are getting impaired,and so this causes a <br /> little more exposure, and it holds folks to more of an accountable standard. <br /> Commissioner Aelion said what is happening now is that the owners do get the notice from <br /> the developer but it just says simply that they asked the City for extended hours, and <br /> basically they are making a statement. This includes the rationale and the reasoning behind <br /> the need. <br /> Vice Mayor Gatto moved and Commissioner Aelion seconded a motion to approve the <br /> 9 <br />
