<br />Summary Minutes: Regular City Commission Meeting September 16, 20 I 0 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />City Attorney Ottinot said like any zoning registration, we can permit or prohibit certain uses <br />in certain areas, and ifit is the Commission's direction to have staff research it, especially the <br />MUR, the east side, and in the MUR district, if time share is a problem, and whether we can <br />prohibit it in that area. He believes her concerns are that unit owners are renting out or using <br />as time shares. Ms. O'Halpin said no, they are getting around the renting because we are <br />really tight on that, but now you just put my name on your condo and then I can use it too <br />because I am an owner. City Attorney Ottinot said that is a different issue, you are talking <br />about property rights issues of a unit owner, and your condo By-Laws should control it. Ms. <br />O'Halpin said she knows but it is superseded by the City saying it is MUR. City Attorney <br />Ottinot said to meet with him and the Zoning Director, and we can talk about this and get <br />more information on it. He will research it and advise the Commission on her concerns. <br /> <br />13B. Nina Mikshakov discussed the Dog Zone in Senator Gwen Margolis Park. She read a <br />letter into the record from residents of her condo complaining about the dog zone, and she <br />also presented an audio recording of barking dogs, and pictures from her balcony looking <br />into the Park. She said this is the only City that has a dog zone up against residences, and she <br />wants it moved to another location. Commissioner Brezin said that she has received several <br />calls from Ms. Mikshakov objecting to the dog zone, and she brought it to the attention of the <br />City Manager. She felt the most important issue was the cleanliness issue. Vice Mayor <br />Thaler said he also dealt with this several months ago, and he also brought it to the City <br />Manager's attention and he reported back to him that it was clean. City Manager Conner <br />said that he has met with her several times, and a couple of times they walked the Park, and <br />his commitment to her, and it remains, is ifthere are any problems, we will do everything in <br />our power to address them. He said the Public Works Department takes it very seriously, they <br />are very proud of that Park, and they maintain it very nicely. They are using enzymes to <br />break down any waste that may remain, and are monitoring it as closely as we can. He said <br />she had also complained about the benches facing her windows, which was resolved. <br /> <br />13e. Alex Levin discussed the potential for the City building an Aquarium. He and a lot of <br />people he has spoken with feel it is a terrible idea to build an aquarium. It would cause <br />congestion and he is concerned about the quality of life which is a big issue. What is the <br />point of bringing an aquarium here when we already have the Seaquarium close by, to use <br />very valuable acreage while we don't have enough commercial infrastructure for ourselves <br />and convenience for the people in our City. What is the rational there? <br /> <br />Vice Mayor Thaler said the rational is really to make Sunny Isles Beach a destination City. <br />From the original concept of this area there was always to be a Park on Sunny Isles <br />Boulevard, and if we had a Park, we would need parking there. Having the Aquarium there <br />just enhances the City and makes it a designation City, and we would expect to have almost <br />20,000 square feet of retail space for additional upscale restaurants and stores. There is a <br />shortage of party places to have weddings, etc., and on the top of this building will be two <br />floors that will have a banquet room and can hold up to 1 ,000 people. Weare in agreement <br />with you about what you are looking for only this was the only area we felt that the City <br />controlled. The aquarium area is something that, other than the land which is City-owned <br />and bought, will cost the City absolutely nothing, and the individuals that are going to put it <br />up are going to spend over $50 Million. The Park and parking lot will be owned by the City, <br />and we will have the income from that on top of having almost 20,000 square feet of upscale <br /> <br />17 <br />
