Summary Minutes: Regular City Commission Meeting September 16, 20 I 0

City of Sunny Isles Beach, Florida

Mayor Edelcup asked if the docks that are still there will remain there, and City Manager
Conner said yes, they will remain. In that area is a concrete slab, and rather than spend a
significant amount of money to remove it, they very cleverly turned it into a picnic area and
did a stair step type of canopy process over it for shade. They relocated the ramp that ties to
the docks and pulled it all back in together.

Vice Mayor Thaler said that we have a grant for over $500,000, do we have any idea what
the additional costs would be to finish it. City Manager Conner said our estimate at this
point is approximately $200,000 how those grants have played out, and he knows that some
were tied to the purchase of the property and other things, which is in the budget. Vice
Mayor Thaler asked ifthere was a timeframe yet, and City Manager Conner said no because
we are using the same group for the Golden Shores Park, and we have until September 15,
2011 to finish it and to secure the grant funds. Therefore we are focusing on the Golden
Shores Park first and then we will immediately turn around and finish the Bella Vista Bay
Park and at that time we can give you a solid date.

Commissioner Goodman asked what the Manager was talking about when he mentioned land
to the east of the Park, and City Manager Conner said that the City had at one time
considered purchasing the land directly to the east which was the Lagoon Restaurant. Mayor
Edelcup said there is still litigation going on with that property.

Commissioner Scholl moved and Commissioner Brezin seconded a motion to approve the
Plan for the Bella Vista Bay Park improvements, and it was approved by a voice vote of
5-0 in favor.

12B. Discussion regarding Combining Condominium Units into a Single Dwelling Unit.

Action: Assistant City Manager/Services Vera reported that this is the application that was
discussed earlier with the Ordinance on first reading (Item 7C.).

Public Speakers: none

It was the consensus of the Commission that no further action is needed on this item as it was
already handled under Item 7C.

13. CITIZENS' FORUM: REQUESTS, PETITIONS & OTHER COMMUNICATIONS

13A. Virginia O'Halpin discussed the zoning of Ocean III. Ms. O'Halpin said that everything
on the east side of AlA is zoned Mixed Use Residential (MUR). There are condos,
apartments, hotels, time shares, and they are now getting letters from lawyers that are getting
information from the City, that this is Mixed Use Residential. We need Single Family
Residence, whether it is called multi-dwelling single family, or high density single family,
she doesn't care. What are we going to do when they turn our condominiums into time
shares because we don't have any provisions to stop two people from buying a
condominium, now they both own it. Lawyers are saying that we can't say that one is the
resident and one is the guest, we need single family residences, not time shares.

16
