Summary Minutes: Regular City Commission Meeting September 16,2010

City of Sunny Isles Beach, Florida

advertising to help cover the rest of the expense of producing this magazine.

Public Speakers: none

Mayor Edelcup said this will replace our traditional City Guide which was costing $24,000
and so we are saving $8,000, with much better coverage.

Commissioner Scholl moved and Commissioner Brezin seconded a motion to approve this
resolution. Resolution No. 2010-1616 was adopted by a voice vote of 5-0 in favor.

10S. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Authorizing
the City Manager to Pay Expert Costs and Related Fees in the Amount of $28,576.62 to
the Law Firm of Hicks & Schreiber, P.A., as Evidenced in Exhibit "A", in the Eminent
Domain Case Entitled City of Sunny Isles Beach vs. Marks Et AI. Case No. 09-55633 CA
23; Providing for an Effective Date.

Action: City Clerk Hines read the title, and City Attorney Ottinot reported noting that this
resolves one of the expert costs issues relating to the property that we acquired by Eminent
Domain located at 215 Sunny Isles Boulevard. There are still some outstanding fee issues
that he is trying to resolve with the attorneys.

Public Speakers: none

Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve this
resolution. Resolution No. 2010-1617 was adopted by a voice vote of 5-0 in favor.

11. MOTIONS

None

12. DISCUSSION ITEMS

12A. Discussion/Presentation of the Bella Vista Bay Park Improvements.

Action: Public Works Director Gio Batista gave a power-point presentation on the Park
which is the property we purchased with a grant at 500 Sunny Isles Boulevard, and that grant
requires that we produce some amenities on that site that may include benches, a pavilion,
and a kayak drop. The Park's primary function is to provide residents and visitors with
access to the Intracoastal Waterway.

City Manager Conner said the way the Park is laid out it is so easily expandable to the east,
we didn't think to originally ask the consultant in his basic layout of the Park to consider this
but he did, and when we saw it we all realized what an amenity it would be regardless of
whether or not you want to ultimately acquire more property in that area to the east. We have
had real interest from several people to provide services such as the kayaking rentals. We
will have a nice facility and amenities that have not been available to the local residents
before. Commissioner Scholl said to also keep in mind, stand-up paddle boards in addition
to kayaks.

Public Speakers: none

15
