<br />I <br /> <br />2.5.4 Public Services Director's written interpretation or clarification; or <br /> <br />2.5.5 A Field Order. <br /> <br />2.6 Representation of CONTRACTOR: <br /> <br />Execution of the Contract by the CONTRACTOR is a representation that <br />CONTRACTOR has visited the site and become familiar with the local conditions under which the <br />Work is to be performed. <br /> <br />2.7 <br /> <br />Before Commencing Operations: <br /> <br />Before undertaking each part of the Work, CONTRACTOR shall carefully study <br />and compare the Contract Documents and check and verifY pertinent figures shown thereon. <br />CONTRACTOR shall promptly report in writing to CITY and Public Services Director any <br />conflict, error or discrepancy which CONTRACTOR may discover and shall obtain a written <br />interpretation or clarification from Public Services Director before proceeding with any Work <br />affected thereby. <br /> <br />ARTICLE 3 - SCOPE OF WORK <br /> <br />3.1 CONTRACTOR shall provide services for the designing and construction of the <br />Project as described in the Contract Documents with all required minimum standards of <br />construction as required by the Contract Documents. <br /> <br />ARTICLE 4 - CONTRACT TIME <br /> <br />4.1 Time is of the Essence of this Contract. The Work shall be commenced upon the <br />date of Contract Commencement specified in the Notice to Proceed and, subject to authorized <br />adjustments, shall be substantially completed no later than December 1, 2013. CONTRACTOR <br />agrees that all Work shall be prosecuted regularly, diligently and uninterrupted at such rate of <br />progress as will ensure full completion thereof within the time specified. Failure to achieve timely, <br />substantial and/or final completion shall be regarded as a breach of this Agreement and subject to <br />the appropriate remedies including but not limited to, liability for liquidated damages in accordance <br />with Paragraph 12.3 herein. <br /> <br />6 <br />
