<br />4.2 Interim milestones and/or Substantial Completion of identified portions of the Work <br />shall be achieved as follows: <br /> <br />4.3 Final Completion of the Work or identified portions of the Work shall be achieved <br />as expeditiously as reasonably practicable. <br /> <br />ARTICLE 5 CONTRACT SUM - GUARANTEED MAXIMUM PRICE <br /> <br />5.1 CITY shall pay CONTRACTOR in current funds as full compensation for the <br />performance of all the Work for the construction of the Public Improvements which shall consist of <br />the Elevated Park and a three hundred eight (308) space Parking Garage which shall include <br />approximately 19,000 square feet of ground level retail area, but subject to additions and deductions <br />by Change Order or Written Amendment as provided in this Agreement, and subject further to <br />possible reductions as set forth in Article 6.2.1 below, the sum of Fifteen Million Dollars and <br />00/100 ($15,000,000.00) (the "Guaranteed Maximum Price"). This Article is subject to the terms <br />and conditions of Article 20 hereof. <br /> <br />5.2 Buy Back Provision. CITY and CONTRACTOR agree and acknowledge that it is <br />the intent of the parties to negotiate and enter into a Buy-Back Agreement relative to the nineteen <br />thousand (19,000) square feet of commercial retail space to be located in the garage. <br /> <br />ARTICLE 6 CONTRACTOR'S RESPONSIBILITIES <br /> <br />6.1 <br /> <br />Responsibilities - Preconstruction Phrase: <br /> <br />6.1.1 Preliminary Evaluation: CONTRACTOR shall provide preliminary <br />evaluation of the CITY's program and Project budget requirements, each in terms of the other. <br /> <br />6.1.2 Consultation: CONTRACTOR will schedule and attend regular meetings <br />and will consult with CITY regarding site use and improvements, and the selection of materials, <br />building systems, and equipment. <br /> <br />6.1.3 Subcontractors and Suppliers: CONTRACTOR shall develop subcontractor <br />interest in the Project and shall furnish to the CITY, information, a list of subcontractors, including <br />suppliers who are to furnish materials or equipment fabricated to a special design.
