<br />such list shall not require the CITY to investigate the qualifications of proposed subcontractors or <br />suppliers, nor shall it waive the right of the CITY later to object to or reject any proposed <br />subcontractor or supplier, and is furnished by CONTRACTOR to CITY for informational purposes <br />only. Subject to the rights of the CITY to purchase supplies and materials in furtherance of the <br />sales tax program as described in Article 6.16 hereof, CONTRACTOR shall have sole authority in <br />awarding subcontractors and purchase orders. <br /> <br />6.1.4 Extent of Responsibility: CONTRACTOR shall be responsible for the <br />architecture, engineering, construction and completion of the Project. <br /> <br />6.2 <br /> <br />Guaranteed Maximum Price: <br /> <br />6.2.1 The Guaranteed Maximum Price includes a separate line item for the <br />CONTRACTOR'S Contingency. The CONTRACTOR'S Contingency is for the sole use of the <br />CONTRACTOR to account for the costs of unknown conditions in the estimate and the execution <br />of the Work. The Guaranteed Maximum Price is also subject to further reduction by an amount <br />calculated by multiplying the applicable Florida sales tax rate times the amount of material and <br />supplies purchased by the CITY under the sales tax program described in Article 6.16 hereof. <br /> <br />The Guaranteed Maximum Price may be modified only as herein provided, including <br />possible changes as a result of additional work and improvements as may be documented in a City <br />Commission approved Change Order[ s]. It is agreed that the Guaranteed Maximum Price includes <br />certain items for which all specifications or determinations have not been made and thus final <br />estimate of cost cannot be made. <br /> <br />6.2.2 The Guaranteed Maximum Price shall include in the Cost of Work only <br />those taxes which are enacted at the time the Guaranteed Maximum Price is established. <br /> <br />6.2.3 The Guaranteed Maximum Price shall include all preconstruction costs. <br /> <br />6.3 Administration: <br /> <br />6.3.1 Those portions of the Work that the CONTRACTOR does not customarily <br />perform with the CONTRACTOR's own personnel shall be performed under subcontracts or by <br />other appropriate agreements with the CONTRACTOR. CITY may not prohibit the <br />CONTRACTOR from obtaining bids from any qualified bidders. The CONTRACTOR shall not <br />be required to contract with anyone to whom the CONTRACTOR has reasonable objection, and the <br />CONTRACTOR shall not contract with anyone to whom the CITY has reasonable objection. <br /> <br />6.3.2 If a specific bidder amount those whose bids are delivered by the <br />CONTRACTOR to the CITY and/or his designees (1) is recommended to the CITY by the <br />CONTRACTOR; (2) is qualified to perform that portion of the Work; and (3) has submitted a bid <br />which conforms to the requirements of the contract Documents without reservations or exceptions, <br />but the CITY requires that another bid (which is mutually acceptable to both parties) be accepted, <br /> <br />8 <br />
