revised version of a model code listed in 553.73(2) as a State <br />Minimum Building Code. Florida Administrative Code 9B- <br />3.047(1)(e) provides that the 1995 edition is the minimum <br />edition. However, the constitutionality of such statute (i.e., <br />authorizing the board to adopt later editions) is questionable, <br />in that it might be construed as an unconstitutional delegation <br />of the legislative power. Would the city wish to revise this <br />to adopt the 1986 edition? Or, the 1995 edition? <br />Or, leave as is? If this is left "as is" the reference to "1982" <br />should be changed to 1983 as there was no 1982 edition. Do <br />so? <br />6 -31.1 (Amendments to One and Two Family Dwelling Code): If <br />the 1995 edition is adopted, these amendments will need to <br />be adjusted as follows. (We have no copy of the 1986 <br />edition and thus cannot make recommendations with regard <br />to it.) <br />(1) R -203, Location on lot: The 1995 edition reference <br />would appear to be "302.1" or, possibly, 302.2, <br />although the last sentence of 302.2 in the 1995 edition <br />may have superseded this amendment. Please review <br />and advise as to the revision desired, if any. <br />(20 R- 216.1, Smoke detectors: The correct reference in the <br />1995 edition is "316.1"; however, the 1995 edition <br />appears to make this amendment unnecessary in that <br />it now requires interconnection of detectors and <br />detectors on each floor, except as to split -level <br />dwellings. Delete this amendment? <br />6 -38 (Standard Building Code, 1982 edition with 1983 <br />amendments, adopted): Same general note and questions as <br />to 6 -31, except that the relevant statute and FAC citations are <br />F.S. § 553.73(2)(a) [which requires the 1988 SBC] and FAC <br />9B- 3.047(1)(a) l . [which designates the 1994 edition as the <br />minimum]. <br />6 -38.1 (Amendments to Standard Building Code): If the 1994 <br />edition is adopted, these amendments will need to be <br />adjusted as follows.
