(9) Section 26 -6, subsection Lb(1), single-family <br />dwellings as a permitted use in R -IAA: Note that <br />F.S. § 419.001 et seq. provides that certain <br />community residential homes are single - family units <br />for zoning purposes without the approval of local <br />governments. While subsection Lb(l) is, arguably, <br />not directly in conflict with the statute, would the city <br />wish to add to this subsection (and all other <br />subsections which permit single- family dwellings) <br />language such as the following? <br />", including those community residential <br />homes declared to be single- family units by <br />state statute." <br />(10) Section 26 -6, subsection Le. (9), "day care centers" <br />as a conditional use: While the issue is far from clear <br />(since special exception or use is not defined) it could <br />be argued that F.S. § 166.0445 [which provides that <br />registered or licensed family day care homes (which <br />are defined in F.S. § 402.302(5)) are a valid <br />residential use and prohibits special exception or use <br />permit requirements in zoning ordinances] would <br />require that this be placed in the permitted use <br />category, as opposed to the conditional use category. <br />(Note that § 26 -12, subsection 4.c refers to a <br />conditional use as a special exception.) This assumes <br />that the term "day care centers" (which is not defined <br />in the zoning ordinance) was intended to refer to <br />"family day care homes." The preceding comments <br />would apply to all other subsections which permit day <br />care centers in residential areas as a conditional use. <br />Move this to the permitted uses category? <br />(11) Section 26 -6, subsection 4.f(6) (b), minimum side <br />yards in R -2 district:: It appears this should read <br />"Side *: Seven and five tenths feet or 10 percent of lot <br />width, whichever is greater. <br />(12) Section 26 -6, subsection 6.f. (S) (b)2., minimum side <br />yards for lots in mobile home parks: It appears this <br />was intended to read "Side: None, provided no mobile <br />home shall be located closer than 20 feet to any other <br />29 <br />
