and decisions upon all claims, questions, and disputes shall be final and conclusive upon <br />the parties thereto. <br />Inspectors shall have no authority to permit deviations from, or to relax any of the <br />provisions of these General Specifications without the written permission or instruction <br />of the Engineer, or to delay the Contract by failure to inspect the materials and work with <br />reasonable promptness. <br />The payment of any compensation, whatever may be its character or form, or the giving <br />of any gratuity, or the granting of any valuable favor by the Contractor to any Inspector, <br />directly or indirectly, is strictly prohibited and any such act on the part of the Contractor <br />will constitute a violation of this Contract. <br />The Public works Director will appoint such inspectors as are necessary to pass upon the <br />amount, quality and character of the materials to be supplied or to supervise the execution <br />of the work contemplated under this Contract. The duties and functions of such officials <br />are purely supervisory and their decisions are to be binding only in the absence of the <br />Public Works Director, and shall be subject to his review, when in the judgment of the <br />inspectors the work or materials are not in accordance with the Specifications, they shall <br />have the power to stop the work, which shall not be resumed until the Engineer has <br />rendered his decision upon the matter in dispute. <br />9. Quantities: <br />The right is reserved to change the Plans and Specifications consistently with the general <br />intention of the Contract for any part of the work or materials, either before or after <br />constructions has begun. Notice of such changes shall be given in writing to the <br />Contractor; such changes are not to be grounds for any claim by the Contractor for <br />damages, nor for the forfeiture of the Contract. <br />10. Materials and Workmanship: <br />The Contractor shall provide the services of all workmen, mechanics, tradesmen and <br />other employees trained and skilled in their various occupations; and all materials except <br />such as may be specifically excluded in the drawings or specifications; and shall <br />construct completely ready for its intended purpose, the structure or parts thereof covered <br />by the Contract, Plans and Specification. These Plans and Specifications intend to <br />provide for the structure or parts thereon under consideration to be fully completed and <br />suitable in every feature for the purpose designed, and the Contractor shall supply all <br />materials and work incidental to, or described, materials and workmanship of every kind <br />shall be first class. The Contractor shall perform his work in proper sequence to the work <br />of other Contractors and to acts or operations of the City, and shall properly join his work <br />to existing or new construction. <br />11. Contract Security: <br />The Constructor agrees to execute and deliver simultaneously with the executed Contract, <br />a Contractor's Performance and Payment Bond on bond forms accepted by the City.
