(a) By delivery of such notice to the Contractor or to any officer of the Contractor be <br />a corporation, or to any agent or superintendent of the Contractor. <br />(b) By mailing such notice by Certified mail to the address of the Contractor's <br />Proposal for bid. <br />5. Datum: <br />All elevations are referred to U.S. Coast and Geodetic Survey Datum, unless otherwise <br />noted on the Plans. <br />6. Base Lines and Bench Marks: <br />The Engineer will be the only person in charge of establishing Base Lines and Bench <br />Mark's (BM's). The Contractor shall layout his work from these engineering control <br />points and shall be responsible for all measurements in connection with the construction, <br />subject to check and correction by the Engineer. The Contractor shall furnish all labor <br />and material, at his expense, Necessary <br />7. Payment of Test by City: <br />Except when otherwise specified in the Special Provisions, the expense of all tests <br />requested by the Engineer will be borne by the City. Procedure for making tests required <br />by the Engineer will be conformance with the Florida Department of Transportation <br />Specifications for the particular material involved. Tests rendering unsatisfactory reports <br />shall be cause for rejection. The costs for all retesting shall be deducted from the final <br />payment made to the Contractor. <br />8. Engineer: <br />The supervision of the execution of this Contract is vested wholly in the Public Works <br />Director and the orders of the City Manager are to be given through him. The instructions <br />of the Public Works Director are to be strictly and promptly followed in every case. The <br />Contractor may designate a foreman or other representative to receive such instruction in <br />his absence, and failing to do so, he will be held responsible for the execution of any <br />instruction it may be necessary to give in his absence. <br />The Public Works is to have free access to the materials an the work at all times for <br />laying out, measuring, inspecting or directing the same, and the Contractor is to afford <br />him all necessary facilities and assistance for so doing. <br />To prevent all disputes and litigations, it is agreed by the parties hereto the Public Works <br />Director shall decide all questions, difficulties and disputes of whatever nature which <br />may arise relative to the interpretation of the Plans, construction, prosecution and <br />fulfillment of his Contract, and as to the Character, quality, amount and value of any <br />work done and materials furnished under or by reason of this Contract, and his estimates <br />General Specifications Page 4 of 16 <br />
